THE SECOND LOW BID WAS IN THE AMOUNT OF $3. THERE APPEARS TO BE NO DOUBT THAT ERRORS WERE MADE BY THE COMPANY. THE EVIDENCE SUBMITTED TO ESTABLISH THE PRICES THE COMPANY ALLEGES IT INTENDED TO BID IS NOT. IF VAN WATERS AND ROGERS IS UNWILLING TO ACCEPT AWARD AT ITS ORIGINAL BID PRICE.

REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 7, 1961, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING ERRORS WHICH VAN WATERS AND ROGERS ALLEGES IT MADE IN ITS BID OPENED AUGUST 18, 1961.

BY INVITATION NO. 62-3 THE U.S. GEOLOGICAL SURVEY, ROCKY MOUNTAIN AREA, REQUESTED BIDS FOR FURNISHING INDUCTION FURNACE, ACCESSORIES AND SUPPLIES. IN RESPONSE VAN WATERS AND ROGERS BID $3,365.25 ON THE 18 ITEMS INVOLVED, WHICH WAS THE LOW BID. A REPRESENTATIVE OF THE COMPANY WAS PRESENT AT THE BID OPENING, AND AT THAT TIME CLAIMED THAT ERRORS HAD BEEN MADE IN ITS BID.

THE COMPANY ALLEGES THAT ITS BID ON ITEM NO. 1 SHOULD BE $1,445 INSTEAD OF $1,410 AS BID AND THAT THE PRICE ON ITEM NO. 5 SHOULD BE $69 INSTEAD OF $78 AS BID AND THE TOTAL BID SHOULD BE REVISED TO $3,391.25. THE COMPANY HAS FURNISHED INFORMATION FROM ITS SUPPLIER SHOWING THESE CHANGES IN ITS PRICE LIST. THE SECOND LOW BID WAS IN THE AMOUNT OF $3,392.25.

THERE APPEARS TO BE NO DOUBT THAT ERRORS WERE MADE BY THE COMPANY, AS ALLEGED. HOWEVER, THE EVIDENCE SUBMITTED TO ESTABLISH THE PRICES THE COMPANY ALLEGES IT INTENDED TO BID IS NOT, IN OUR OPINION, SUFFICIENT TO JUSTIFY THE REQUESTED REVISION OF ITS BID. CONSEQUENTLY, IF VAN WATERS AND ROGERS IS UNWILLING TO ACCEPT AWARD AT ITS ORIGINAL BID PRICE, ITS BID SHOULD BE DISREGARDED.
