TWO ADDENDA TO THIS INVITATION WERE ISSUED RESTATING THE FLOOR LOAD CAPACITY FOR A PART OF THE REQUIRED SPACE TO BE USED FOR OFFICE SPACE AND EXTENDING THE BID OPENING TO MARCH 28. SEVENTEEN BIDS WERE RECEIVED. THIS OFFER WAS FOR NEW CONSTRUCTION. THREE OTHER OFFERS WERE RECEIVED OFFERING SPACE AT A LOWER RATE THAN THE RATE ASKED BY YOU. THE DEPARTMENT REPLIED THAT THE SPACE IN THE SPRINGFIELD AREA WAS UNACCEPTABLE AND SPECIFIED OTHER AREAS CONSIDERED ACCEPTABLE FOR ACIC OPERATIONS. THE LIMITS OF THE GENERAL AREA SATISFACTORY TO THE USING AGENCY WERE ESTABLISHED AND IT WAS DECIDED TO REJECT ALL BIDS UNDER INVITATION FOR BIDS NO.

REFERENCE IS MADE TO YOUR LETTER OF JUNE 14, 1961, PROTESTING THE AWARD OF A LEASE TO ANY OTHER BIDDER UNDER INVITATION FOR BIDS NO. GS PBS-03- 529ISSUED ON MAY 15, 1961.

YOU PROTEST THE MANNER IN WHICH GENERAL SERVICES ADMINISTRATION (GSA) PROCEEDED IN ADVERTISING FOR THE SPACE REQUIRED BY THE GOVERNMENT.

ON AUGUST 11, 1960, THE DEPARTMENT OF DEFENSE (DOD) REQUESTED 72,250 SQUARE FEET (LATER AMENDED TO 74,620 SQUARE FEET) OF SPACE FOR THE RELOCATION OF THE AERONAUTICAL CHART AND INFORMATION CENTER (ACIC) FROM THE LANGSTON AREA TO AN AREA AS CLOSE AS POSSIBLE TO ARLINGTON HALL STATION. ACCORDINGLY, WITH THE CONCURRENCE OF ACIC, INVITATION FOR BIDS NO. GS-03-B-517 DATED FEBRUARY 27, 1961, WAS ISSUED FOR FURNISHING 74,620 SQUARE FEET OF SPACE "IN THE CITY OF ALEXANDRIA OR ARLINGTON, OR FAIRFAX COUNTY, VIRGINIA, PREFERABLY IN CLOSE PROXIMITY TO ARLINGTON HALL STATION.' TWO ADDENDA TO THIS INVITATION WERE ISSUED RESTATING THE FLOOR LOAD CAPACITY FOR A PART OF THE REQUIRED SPACE TO BE USED FOR OFFICE SPACE AND EXTENDING THE BID OPENING TO MARCH 28, 1961. SEVENTEEN BIDS WERE RECEIVED. YOU OFFERED TO LEASE 74,620 SQUARE FEET OF SPACE AT 402 WEST FAIRFAX STREET, FALLS CHURCH, VIRGINIA, AT AN ANNUAL RENTAL OF $175,940, INCLUDING BUILDING SERVICES AND UTILITIES FOR A FIRM 5-YEAR TERM. THIS OFFER WAS FOR NEW CONSTRUCTION. THREE OTHER OFFERS WERE RECEIVED OFFERING SPACE AT A LOWER RATE THAN THE RATE ASKED BY YOU. AFTER THE GSA REGIONAL OFFICE HAD INFORMED DOD THAT THE LOWEST RESPONSIVE BID APPEARED TO BE FOR APPROXIMATELY 74,400 SQUARE FEET OF SPACE IN THE SHIRLEY INDUSTRIAL AREA, SPRINGFIELD, VIRGINIA, AT AN ANNUAL RENTAL OF $144,000, THE DEPARTMENT REPLIED THAT THE SPACE IN THE SPRINGFIELD AREA WAS UNACCEPTABLE AND SPECIFIED OTHER AREAS CONSIDERED ACCEPTABLE FOR ACIC OPERATIONS. THEREAFTER AT A MEETING OF REPRESENTATIVES OF DOD AND GSA, THE LIMITS OF THE GENERAL AREA SATISFACTORY TO THE USING AGENCY WERE ESTABLISHED AND IT WAS DECIDED TO REJECT ALL BIDS UNDER INVITATION FOR BIDS NO. GS-03-B-517.

ON MAY 15, 1961, COPIES OF THE SECOND INVITATION FOR BIDS (NO. GS PBS-03- 529) WERE DISTRIBUTED TO ALL PARTIES WHO HAD EVIDENCED AN INTEREST IN THE ORIGINAL INVITATION. THE SECOND INVITATION WAS IDENTICAL TO THE FIRST ONE EXCEPT THAT THE SPACE WAS REQUESTED "IN VIRGINIA, WITHIN THE AREA BOUNDED BY WASHINGTON NATIONAL AIRPORT, FAIRLINGTON, BAILEY'S CROSSROADS, BALLSTON AND ROSSLYN.' BIDS WERE OPENED ON MAY 25, 1961. SIX BIDS WERE RECEIVED. YOUR BID WAS THE LOWEST RECEIVED. HOWEVER, THE SPACE YOU OFFERED WAS OUTSIDE THE LOCATION DESCRIBED IN THE INVITATION AND IT HAS BEEN CONSIDERED NONRESPONSIVE. IT HAS BEEN REPORTED THAT NO AWARD HAS BEEN MADE UNDER THE SECOND INVITATION AND THAT GSA PROPOSES TO REJECT ALL BIDS BECAUSE THE USING AGENCY'S REQUIREMENTS HAVE BEEN CHANGED.

IN THE CIRCUMSTANCES, WE FIND NO BASIS FOR OBJECTING TO THE PROPOSED ACTION IN REJECTING ALL BIDS.
