THAT IT WAS DETERMINED TO REJECT ALL BIDS AND READVERTISE BECAUSE THE THREE LOW BIDDERS HAD FAILED TO SUBMIT REQUESTED EVIDENCE AS TO THEIR RESPONSIBILITY AND THE OTHER BID PRICES WERE DETERMINED TO BE TOO HIGH IN RELATION TO COST ESTIMATES. THE CONTRACTING AGENCY MAY REJECT ALL BIDS AND READVERTISE WHEN IT IS DEEMED IN THE BEST INTEREST OF THE GOVERNMENT TO DO SO.

WE HAVE YOUR TELEGRAM OF MAY 1, 1961, ON BEHALF OF CRAWFORD VAN LINES AND SOUTHWEST DRAYAGE COMPANY, A JOINT VENTURE, IN CONNECTION WITH THE REJECTION OF THEIR BID IN RESPONSE TO INVITATION NO. GS-06-T 44, OPENED APRIL 4, 1961.

WE HAVE BEEN ADVISED BY THE TRANSPORTATION AND PUBLIC UTILITIES SERVICE IN REGION 6, GENERAL SERVICES ADMINISTRATION, THAT IT WAS DETERMINED TO REJECT ALL BIDS AND READVERTISE BECAUSE THE THREE LOW BIDDERS HAD FAILED TO SUBMIT REQUESTED EVIDENCE AS TO THEIR RESPONSIBILITY AND THE OTHER BID PRICES WERE DETERMINED TO BE TOO HIGH IN RELATION TO COST ESTIMATES. THE CONTRACTING AGENCY MAY REJECT ALL BIDS AND READVERTISE WHEN IT IS DEEMED IN THE BEST INTEREST OF THE GOVERNMENT TO DO SO. IN OUR VIEW THE FACTS AS PRESENTED AMPLY SUPPORT THE CONTRACTING OFFICER'S ACTION, AND WE SEE NO REASON FOR QUESTIONING ITS LEGALITY.
