WHO ARE IN FACT DEPENDENT UPON THE OFFICER. WHO ARE IN FACT DEPENDENT UPON THE OFFICER. WHO WAS AND IS IN FACT DEPENDENT UPON THE OFFICER. PAYMENT OF THE CLAIMS OF THESE OFFICERS FOR THE TRAVEL OF THEIR DEPENDENT CHILDREN WILL BE PASSED TO CREDIT IF SUCH CLAIM IS OTHERWISE PROPERLY PAYABLE UNDER THE PROVISIONS OF CHAPTER 7 OF THE JOINT TRAVEL REGULATIONS. THE PAPERS SUBMITTED WITH YOUR LETTER ARE RETURNED. SHOULD BE INCLUDED IN THE ACCOUNT WHEREIN CREDIT UNDER THIS DECISION IS FIRST CLAIMED.

BY FIRST ENDORSEMENT DATED NOVEMBER 2, 1960, THE COMMANDANT, UNITED STATES COAST GUARD, FORWARDED YOUR LETTER OF THE SAME DATE, WITH ENCLOSURES, REQUESTING DECISION AS TO THE DEPENDENCY STATUS OF THE MINOR STEPCHILDREN AND ADOPTED CHILDREN IN THE CASES OF FOUR HEREAFTER NAMED OFFICERS, FOR THE PURPOSES OF SUCH OFFICERS' ENTITLEMENT TO TRANSPORTATION OF THEIR DEPENDENTS AT GOVERNMENT EXPENSE INCIDENT TO A PERMANENT CHANGE OF STATION UNDER THE PROVISIONS OF ACTION 303 (C) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 814, AS AMENDED, AND THE JOINT TRAVEL REGULATIONS.

SECTION 102 (G) OF THE 1949 ACT, 63 STAT. 804, DEFINES THE TERM "DEPENDENT" AS INCLUDING STEPCHILDREN AND ADOPTED CHILDREN WHEN THEY ARE IN FACT DEPENDENT ON THE SERVICE MEMBER.

BASED ON THE ASSUMPTION THAT A VALID MARRIAGE HAS BEEN ESTABLISHED IN THE SUBMITTED CASES, THE EVIDENCE FURNISHED IN THE CASES SHOWS THAT CHBOSN (W- 2) WASEY S. HAYES (27523), USCG, RETIRED, HAS A MINOR STEPDAUGHTER, PATRICIA L. SMITH, WHO IS IN FACT DEPENDENT UPON THE OFFICER; THAT CHMACH (W-2) JAMES R. DUGGER (27888), USCG, HAS MINOR STEPCHILDREN, DONNA L. O- CONNOR AND MICHAEL P. O-CONNOR, WHO ARE IN FACT DEPENDENT UPON THE OFFICER; THAT BY ADOPTION, BOSN (W-1) ROBERT A. JONES (28161), USCG, HAS MINOR CHILDREN, WILLIAM E. JONES AND ROBERT E. L. JONES, WHO ARE IN FACT DEPENDENT UPON THE OFFICER; AND THAT MACH (W-1) JACK B. MEADOWCROFT (28106), USCG, HAD A MINOR STEPCHILD, SINCE ADOPTED, MELVIN JACK MEADOWCROFT, WHO WAS AND IS IN FACT DEPENDENT UPON THE OFFICER. EACH OF THE OFFICERS HAS MADE A CLAIM FOR REIMBURSEMENT FOR TRAVEL PERFORMED BY HIS DEPENDENTS INCIDENT TO A PERMANENT CHANGE OF STATION.

ACCORDINGLY, PAYMENT OF THE CLAIMS OF THESE OFFICERS FOR THE TRAVEL OF THEIR DEPENDENT CHILDREN WILL BE PASSED TO CREDIT IF SUCH CLAIM IS OTHERWISE PROPERLY PAYABLE UNDER THE PROVISIONS OF CHAPTER 7 OF THE JOINT TRAVEL REGULATIONS.

THE PAPERS SUBMITTED WITH YOUR LETTER ARE RETURNED.

THIS DECISION, OR A COPY, SHOULD BE INCLUDED IN THE ACCOUNT WHEREIN CREDIT UNDER THIS DECISION IS FIRST CLAIMED.
