YOUR LETTER OF JULY 22, 1960 FILE C:F, FORWARDED AUGUST 2, 1960, BY THE ADMINISTRATIVE ASSISTANT SECRETARY OF THE TREASURY, REQUESTS OUR DECISION CONCERNING THE REIMBURSEMENT OF PREMIUMS PAID FOR FLIGHT INSURANCE WHILE ON OFFICIAL TRIPS, REPRESENTED BY THE RECLAIM TRAVEL VOUCHER FOR $7 IN FAVOR OF MR. HART H. SPIEGEL, CHIEF COUNSEL.

WITH THE VOUCHER MR. SPIEGEL SUBMITTED A COPY OF HIS MEMORANDUM DATED JUNE 3, 1960, STATING WHY HE FEELS HE SHOULD BE ALLOWED THE ITEMS (FLIGHT INSURANCE PURCHASED BY HIM ON JUNE 7 AND 9, 1960, IN THE RESPECTIVE AMOUNTS OF $5 AND $2) WHICH WERE DISALLOWED ADMINISTRATIVELY ON A PRIOR VOUCHER. IN BOTH HIS MEMORANDUM AND IN YOUR LETTER REFERENCE IS MADE TO OUR DECISION OF SEPTEMBER 20, 1956, B 128981, TO A FINANCE OFFICER OF THE DEPARTMENT OF THE ARMY. IN THAT REGARD, WE ENCLOSE HEREWITH A COPY OF OUR RECENT DECISION B-143320 DATED JULY 12, 1960, 40 COMP. GEN. 11, IN A SIMILAR CASE.

WE HAVE CAREFULLY CONSIDERED MR. SPIEGEL'S VIEWS; HOWEVER, IN THE LIGHT OF THE CITED DECISIONS AND THE FACTS IN HIS CASE WE WOULD NOT BE WARRANTED IN CHANGING OUR CONCLUSION.

IN THE FIELD OF LIFE INSURANCE THE CONGRESS ALREADY HAS PROVIDED PREMIUM CONTRIBUTIONS AND INSURANCE COVERAGE TO THE EXTENT AUTHORIZED BY 5 U.S.C. 2091-2103. ANY EXTENSIONS OF SUCH CONTRIBUTIONS DIRECTLY OR INDIRECTLY OR INCREASE IN THE FIELD OF COVERAGE WOULD THEREFORE APPEAR TO BE APPROPRIATE MATTERS FOR LEGISLATION RATHER THAN FOR REGULATION OR RULE OF DECISION.
