GARTON WAS EMPLOYED AS A MISCELLANEOUS DUPLICATING EQUIPMENT OPERATOR. HE WAS UNABLE TO REPORT FOR DUTY BECAUSE OF EXTREME WEATHER CONDITIONS CAUSED BY A TORNADO AND WAS. GARTON WAS A PER ANNUM EMPLOYEE. THE TEMPORARY NATURE AND SHORT DURATION OF HIS APPOINTMENT WOULD HAVE NO BEARING UPON THE QUESTION AS TO WHETHER HE COULD PROPERLY BE EXCUSED FROM DUTY ON THAT DAY. YOUR LETTER OF JUNE 10, 1960, REQUESTS OUR DECISION AS TO WHETHER THE VOUCHER TRANSMITTED THEREWITH, REPRESENTING SALARY FOR ONE DAY, MAY 6, 1960, IN THE NET AMOUNT OF $9.88, CLAIMED BY KENNETH C. GARTON, A FORMER EMPLOYEE OF THE SOUTHWESTERN POWER ADMINISTRATION, MAY BE CERTIFIED FOR PAYMENT IN VIEW OF THE NATURE AND DURATION OF HIS APPOINTMENT.

MR. GARTON WAS EMPLOYED AS A MISCELLANEOUS DUPLICATING EQUIPMENT OPERATOR, GS-2, EFFECTIVE APRIL 25, 1960, FOR A PERIOD NOT TO EXTEND BEYOND MAY 24, 1960. ON MAY 6, 1960, HE WAS UNABLE TO REPORT FOR DUTY BECAUSE OF EXTREME WEATHER CONDITIONS CAUSED BY A TORNADO AND WAS, THEREFORE, ADMINISTRATIVELY EXCUSED FROM DUTY WITHOUT LOSS OF PAY.

SINCE MR. GARTON WAS A PER ANNUM EMPLOYEE, THE TEMPORARY NATURE AND SHORT DURATION OF HIS APPOINTMENT WOULD HAVE NO BEARING UPON THE QUESTION AS TO WHETHER HE COULD PROPERLY BE EXCUSED FROM DUTY ON THAT DAY. CONSEQUENTLY, THE VOUCHER, WHICH IS RETURNED HEREWITH, MAY BE CERTIFIED FOR PAYMENT, IF OTHERWISE CORRECT.
