UNITED STATES COAST GUARD: REFERENCE IS MADE TO YOUR LETTER OF MARCH 21. TO HAVE BEEN MADE IN ITS BID SUBMITTED IN RESPONSE TO INVITATION FOR BIDS NO. TREATED TIMBER CHAFING STRAKES FOR WHICH A UNIT PRICE PER FOOT WAS TO BE SHOWN UNDER ITEM 2 (B). THE BIDS ARE TO BE EVALUATED ON THE LOWEST TOTAL BID FIGURE WHICH WILL INCLUDE THE SUM OF THE LUMP-SUM BID FOR ITEM 2 (A) PLUS A QUANTITY OF 80 LINEAL FEET OF TIMBER STRAKES AT THE UNIT PRICE QUOTED UNDER ITEM 2 (B). FIVE BIDS WERE RECEIVED IN RESPONSE TO THE INVITATION INCLUDING A BID FROM F. IS REPORTED THAT AFTER THE BIDS HAD BEEN OPENED AND RECORDED SOME OF THE BIDDERS PRESENT. WHICH IS THE DIFFERENCE BETWEEN THE PRICES QUOTED FOR ITEMS 1 AND 2 (A).

TO THE COMMANDANT, HEADQUARTERS, UNITED STATES COAST GUARD:

REFERENCE IS MADE TO YOUR LETTER OF MARCH 21, 1960, REQUESTING A DECISION AS TO THE ACTION THAT SHOULD BE TAKEN WITH RESPECT TO AN ERROR ALLEGED BY F. C. TAYLOR, INC., TO HAVE BEEN MADE IN ITS BID SUBMITTED IN RESPONSE TO INVITATION FOR BIDS NO. SO-556-60 ISSUED BY THE FIRST COAST GUARD DISTRICT.

THE INVITATION REQUESTED LUMP-SUM BIDS TO BE OPENED ON MARCH 8, 1960, FOR ITEM 1, REPLACEMENT OF THE TIMBER PILE SUBSTRUCTURE AT THE UNITED STATES COAST GUARD BRANT POINT LIGHT, ITEM 2 (A), REPAIRS AND REPLACEMENTS OF VARIOUS TIMBER MEMBERS OF LAUNCHWAY CATWALK AT THE UNITED STATES COAST GUARD BRANT POINT LIFE BOAT STATION, WITH THE EXCEPTION OF THE 3 IN. BY 10 IN. TREATED TIMBER CHAFING STRAKES FOR WHICH A UNIT PRICE PER FOOT WAS TO BE SHOWN UNDER ITEM 2 (B). FOR PURPOSES OF BID COMPARISON ONLY, THE BIDS ARE TO BE EVALUATED ON THE LOWEST TOTAL BID FIGURE WHICH WILL INCLUDE THE SUM OF THE LUMP-SUM BID FOR ITEM 2 (A) PLUS A QUANTITY OF 80 LINEAL FEET OF TIMBER STRAKES AT THE UNIT PRICE QUOTED UNDER ITEM 2 (B).

FIVE BIDS WERE RECEIVED IN RESPONSE TO THE INVITATION INCLUDING A BID FROM F. C. TAYLOR, INC., WHICH SHOWED A LUMP-SUM PRICE OF $6,296 FOR ITEM 1; $8,684.70 FOR ITEM 2 (A) AND A UNIT PRICE OF $2.22 FOR ITEM 2 (B). IS REPORTED THAT AFTER THE BIDS HAD BEEN OPENED AND RECORDED SOME OF THE BIDDERS PRESENT, AFTER CHECKING OVER THE PRICES, INTIMATED THAT F. C. TAYLOR, INC., HAD APPARENTLY ERRED IN SUBMITTING A BID OF $8,684.70 FOR ITEM 2 (A) IN THAT HE HAD INCLUDED THE COST OF ITEM 1 UNDER ITEM 2 (A).

IN A TELEPHONE CONVERSATION F. C. TAYLOR, INC., ADVISED THAT THE COST OF ITEM 1 HAD BEEN ERRONEOUSLY INCLUDED IN THE COST OF ITEM 2 (A). TELEGRAM AND LETTERS OF MARCH 9 THE BIDDER REQUESTED THAT THE PRICE FOR ITEM 2 (A) BE CORRECTED TO $2,388.70, WHICH IS THE DIFFERENCE BETWEEN THE PRICES QUOTED FOR ITEMS 1 AND 2 (A). THE BIDDER SUBMITTED IN SUPPORT OF ITS ALLEGED ERROR ITS WORKSHEET WHICH SHOWS VARIOUS ITEMS OF COST AND SHOWS ALSO THAT THE TOTAL AMOUNT FOR ITEM 1 WAS $6,296 AND THAT THE TOTAL FOR ITEM 2 (A) WAS $2,388.70. THE AMOUNT OF $2,388.70 IS MORE IN LINE WITH THE PRICES QUOTED BY THE MAJORITY OF THE OTHER BIDDERS FOR ITEM 2 (A).

ON THE BASIS OF THE FACTS AND EVIDENCE OF RECORD THERE APPEARS NO DOUBT THAT AN ERROR WAS MADE BY INCLUDING UNDER ITEM 2 (A) THE COST OF ITEM 1 AND THAT THE INTENDED PRICE FOR ITEM 2 (A) WAS $2,388.70 AS ALLEGED. ACCORDINGLY, ITEM 2 (A) OF THE BID OF F. C. TAYLOR, INC., SHOULD BE CORRECTED TO PROVIDE FOR A PRICE OF $2,388.70 AND THE BID, AS SO CORRECTED, MAY BE CONSIDERED FOR AWARD.
