EXPLAINING THAT ITS QUOTATION ON THE THREE ITEMS WAS BASED "IN ERROR" ON THE PRICE PER BOARD FEET. QUANTITIES OF MAHOGANY LUMBER OF DIFFERENT THICKNESSES WERE SPECIFIED IN SQUARE FEET SURFACE MEASURE INSTEAD OF BOARD FEET AS IS CUSTOMARY IN THE PURCHASE OF LUMBER. ACCORDINGLY AND SINCE THE ERROR WAS ALLEGED AND EXPLAINED PRIOR TO AWARD. ARE RETURNED.

REFERENCE IS MADE TO YOUR LETTER, WITH ENCLOSURES, DATED FEBRUARY 27, 1960, REQUESTING A DECISION AS TO WHETHER THE BID OF THE MARYLAND LUMBER COMPANY, BALTIMORE, MARYLAND, SHOULD BE DISREGARDED IN MAKING AN AWARD PURSUANT TO INVITATION NO. 6014, DATED FEBRUARY 13, 1960, FOR FURNISHING CERTAIN LUMBER FOR THE SENATE OFFICE BUILDING.

THE INVITATION CALLED FOR BIDS AT A LUMP SUM PRICE FOR FURNISHING THREE ITEMS OF MAHOGANY LUMBER AS SPECIFIED AND IN THE RESPECTIVE QUANTITIES OF 500, 400 AND 400 SQUARE FEET SURFACE MEASURE. IN RESPONSE TO THE INVITATION THE FOLLOWING BIDS WERE RECEIVED AND OPENED, AS SCHEDULED, ON FEBRUARY 23, 1960:

THEREAFTER, IN LETTER DATED FEBRUARY 24, 1960, WHICH WAS RECEIVED IN YOUR OFFICE ON FEBRUARY 26, THE MARYLAND LUMBER COMPANY, THE LOW BIDDER, REQUESTED THAT ITS BID BE WITHDRAWN, EXPLAINING THAT ITS QUOTATION ON THE THREE ITEMS WAS BASED "IN ERROR" ON THE PRICE PER BOARD FEET, WHILE THE QUOTATION REQUEST CALLED FOR SQUARE FEET.'

YOU STATE THAT BECAUSE OF THE SPECIAL DRESSING REQUIRED, QUANTITIES OF MAHOGANY LUMBER OF DIFFERENT THICKNESSES WERE SPECIFIED IN SQUARE FEET SURFACE MEASURE INSTEAD OF BOARD FEET AS IS CUSTOMARY IN THE PURCHASE OF LUMBER; ALSO, THAT A COMPARISON OF THE MARYLAND LUMBER COMPANY'S BID WITH THE OTHER BIDS RECEIVED CONFIRMS THE BIDDER'S CLAIM OF ERROR. YOU FURTHER STATE THAT, ACCORDING TO YOUR ESTIMATE, THE COMPANY'S TOTAL BID PRICE BASED ON ITS INTENDED UNIT PRICE PER SQUARE BOARD FEET WOULD BE $995.50.

ON THE RECORD, THEREFORE, THERE APPEARS LITTLE, IF ANY, DOUBT THAT THE MARYLAND LUMBER COMPANY MADE AN ERROR IN ITS BID, AS ALLEGED. ACCORDINGLY AND SINCE THE ERROR WAS ALLEGED AND EXPLAINED PRIOR TO AWARD, THE COMPANY'S BID MAY BE DISREGARDED IN MAKING AN AWARD PURSUANT TO INVITATION NO. 6014.

THE DOCUMENTS FORWARDED WITH YOUR LETTER, EXCEPT THE ABSTRACT OF BIDS AND THE MARYLAND LUMBER COMPANY'S LETTER OF FEBRUARY 24, 1960, ARE RETURNED.
