" TO NOVEMBER 1952 WHILE YOU WERE EMPLOYED BY THE DEPARTMENT OF THE ARMY AS A CIVILIAN IN OKINAWA. YOU WERE ADVISED THAT THERE WAS NO RECORD OF ANY OVERCHARGE FOR QUARTERS FOR THE PERIOD PRIOR TO NOVEMBER 9. THE BASIS FOR THAT STATEMENT IS THE REPORT OF THE DEPARTMENT OF THE ARMY WHICH READS AS FOLLOWS: "MR. DELA CRUZ WAS PROPERLY REIMBURSED FOR THE OVERDEDUCTION OF QUARTERS CHARGES. THIS HEADQUARTERS DID NOT EFFECT ANY OVERDEDUCTIONS UNTIL 9 NOVEMBER 1952 BY A LOCAL DIRECTIVE THEREFORE THERE ARE NO CLAIMS PRIOR TO THAT DATE TO BE PAID TO ANYONE.'. SINCE THE RECORD SHOWS THAT NO OVERCHARGES WERE EFFECTED PRIOR TO NOVEMBER 9. IS SUSTAINED.

YOUR LETTER OF NOVEMBER 3, 1959, REQUESTS RECONSIDERATION OF OUR OFFICE SETTLEMENT DATED SEPTEMBER 24, 1959, WHICH DISALLOWED YOUR CLAIM FOR REFUND OF OVERCHARGES FOR QUARTERS IN AN AMOUNT REPRESENTING OVERDEDUCTIONS FROM YOUR COMPENSATION ALLEGEDLY MADE "FROM SOMETIME IN1949," TO NOVEMBER 1952 WHILE YOU WERE EMPLOYED BY THE DEPARTMENT OF THE ARMY AS A CIVILIAN IN OKINAWA, RYUKYU ISLANDS.

BY OUR SETTLEMENT DATED SEPTEMBER 24, 1949, YOU WERE ADVISED THAT THERE WAS NO RECORD OF ANY OVERCHARGE FOR QUARTERS FOR THE PERIOD PRIOR TO NOVEMBER 9, 1952. THE BASIS FOR THAT STATEMENT IS THE REPORT OF THE DEPARTMENT OF THE ARMY WHICH READS AS FOLLOWS:

SINCE THE RECORD SHOWS THAT REFUND HAS BEEN MADE TO YOU IN THE AMOUNT OF $23.30, REPRESENTING OVERDEDUCTIONS MADE DURING THE PERIOD NOVEMBER 9, 1952, TO FEBRUARY 17, 1953, AND SINCE THE RECORD SHOWS THAT NO OVERCHARGES WERE EFFECTED PRIOR TO NOVEMBER 9, 1952, SETTLEMENT DATED SEPTEMBER 24, 1959, IS SUSTAINED.
