IT WAS ALSO AGREED THAT THE 5 PERCENT RATE OF INTEREST ON CREDIT SALES PROPOSED IN SUBSECTION 2-V 401.04A WAS LESS THAN PREVAILING INTEREST RATES AND THAT THIS SUBSECTION WILL BE REVISED TO PROVIDE FOR A RATE OF 5 3/4 PERCENT. YOUR LETTER OF OCTOBER 21, 1959, TRANSMITTED FOR OUR REVIEW COPIES OF PROPOSED REVISION OF CHAPTERS I, IV, V, AND VI, TITLE 2, REAL PROPERTY MANAGEMENT, REGULATIONS OF THE GENERAL SERVICES ADMINISTRATION.

OUR COMMENTS FOLLOW:

SUBSECTION 2-IV-201.02B PROVIDES THAT STANDARD FORM 118, REPORT OF EXCESS REAL PROPERTY, SHALL BE ACCOMPANIED BY A REPORT BY AN ATTORNEY OR OTHER QUALIFIED PERSON ON THE GOVERNMENT'S LEGAL TITLE TO THE PROPERTY. THIS REQUIREMENT COULD RESULT IN ADDITIONAL COSTS AND POSSIBLE DELAYS INCIDENT TO TITLE SEARCH. DURING INFORMAL DISCUSSIONS OF THIS MATTER WITH OFFICIALS OF YOUR AGENCY, IT WAS AGREED THAT THIS PROPOSED SUBSECTION WILL BE CHANGED TO REQUIRE ONLY A REPORT BY A QUALIFIED AGENCY PERSON CONCERNING WHATEVER TITLE INFORMATION THE AGENCY MAY POSSESS IN ITS FILES. IT WAS ALSO AGREED THAT THE 5 PERCENT RATE OF INTEREST ON CREDIT SALES PROPOSED IN SUBSECTION 2-V 401.04A WAS LESS THAN PREVAILING INTEREST RATES AND THAT THIS SUBSECTION WILL BE REVISED TO PROVIDE FOR A RATE OF 5 3/4 PERCENT.

SUBSECTION 2-IV-201.05A.2 CONCERNS LAND WITHDRAWN FROM THE PUBLIC DOMAIN BUT WHICH HAS BEEN DETERMINED AS NOT BEING SUITABLE FOR RETURN TO THE PUBLIC DOMAIN. SUBSECTION 2-V-405.05C CONCERNS THE RELEASE OF TRANSFER RESTRICTIONS ON PROPERTY DISPOSED OF FOR USE AS SHRINES, MEMORIALS, OR FOR RELIGIOUS PURPOSES. WE BELIEVE THAT EACH OF THESE SECTIONS SHOULD PROVIDE FOR DOCUMENTATION, ADEQUATE FOR AUDIT PURPOSES, OF THE BASES ON WHICH THE REQUIRED DETERMINATIONS ARE MADE.

SUBSECTION 2-IV-202.07B CONTAINS THE PHRASE "TRANSFER IS FOR THE PURPOSE OF UPGRADING FACILITIES.' WE BELIEVE IT WOULD BE DESIRABLE TO INCLUDE A DEFINITION OF THIS PHRASE IN SECTION 102, DEFINITION OF TERMS.

WE SUGGEST THAT ONLY PROPOSED SALES OF PROPERTY VALUED AT OVER $500 OR $1,000 BE SUBMITTED FOR INCLUSION IN THE DAILY "SYNOPSIS OF U.S. GOVERNMENT PROPOSED PROCUREMENTS, SALES AND CONTRACT AWARDS" (SEE SUBSECTION 2-V-401.01) IN ORDER TO KEEP THE EXPENSES OF DISPOSAL IN LINE WITH THE SALES VALUE OF THE PROPERTY.
