TO THE VIRGINIAN RAILWAY COMPANY: FURTHER REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 27. YOU CONTEND THAT ADDITIONAL FREIGHT CHARGES FOR $103.19 ARE DUE FOR THE TRANSPORTATION OF GOVERNMENT PROPERTY CONSISTING OF A TRACTOR WITH ATTACHMENTS. AN EXAMINATION OF THE RECORD SHOWS THAT THE TRACTOR AND GRADING ATTACHMENTS WERE PART OF A SHIPMENT. THE INBOUND FREIGHT CHARGES OF $588.96 WERE PAID TO THE NEW YORK CENTRAL RAILROAD COMPANY ON THEIR BILL NO. 988785-57. OUTBOUND CHARGES OF $341.26 ON GOVERNMENT BILL OF LADING WZ-T 368130 WERE PAID TO THE VIRGINIAN RAILWAY COMPANY ON BILL NO. 38060. THE TOTAL THROUGH CHARGES PAID ON THIS SHIPMENT WERE ($233.70 PLUS $341.26) $574.96. THESE CHARGES WERE COMPUTED ON THE TRANSIT WEIGHT OF 19.

FURTHER REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 27, 1959, FILE NO. 6055 MKA, IN WHICH YOU REQUEST A REVIEW OF THE DISALLOWANCE OF THE VIRGINIAN RAILWAY BILL 38276, SUPPLEMENTAL TO 38060-A, DATED DECEMBER 1958, OUR CLAIM NO. TK-667638.

YOU CONTEND THAT ADDITIONAL FREIGHT CHARGES FOR $103.19 ARE DUE FOR THE TRANSPORTATION OF GOVERNMENT PROPERTY CONSISTING OF A TRACTOR WITH ATTACHMENTS, WEIGHING 19,475 POUNDS, AND A GREASE SPRAYING OUTFIT, WEIGHING 5,965 POUNDS. THIS SHIPMENT MOVED FROM MARION, OHIO, TO NORFOLK, VIRGINIA, UNDER BILL OF LADING NO. WZ-T-368130. TO SUPPORT YOUR CHARGES YOU REFER TO ITEM 400 OF THE VIRGINIAN RAILWAY COMPANY'S WHARFAGE, STORAGE, HANDLING AND TERMINAL PRIVILEGES TARIFF 1813-N.

AN EXAMINATION OF THE RECORD SHOWS THAT THE TRACTOR AND GRADING ATTACHMENTS WERE PART OF A SHIPMENT, WEIGHING 49,080 POUNDS, WHICH MOVED UNDER GOVERNMENT BILL OF LADING NO. WY 7259870 ON SEPTEMBER 4, 1957, FROM DECATUR, ILLINOIS, TO MARION, OHIO, FOR STORAGE IN TRANSIT. THE INBOUND FREIGHT CHARGES OF $588.96 WERE PAID TO THE NEW YORK CENTRAL RAILROAD COMPANY ON THEIR BILL NO. 988785-57. A PORTION OF THE AFOREMENTIONED CHARGES, $233.70, REPRESENTS THE CHARGE FOR THE SHIPMENT OF 19,475 POUNDS FROM DECATUR TO MARION AT 120 CENTS PER 100 POUNDS. OUTBOUND CHARGES OF $341.26 ON GOVERNMENT BILL OF LADING WZ-T 368130 WERE PAID TO THE VIRGINIAN RAILWAY COMPANY ON BILL NO. 38060. THE TOTAL THROUGH CHARGES PAID ON THIS SHIPMENT WERE ($233.70 PLUS $341.26) $574.96. IT NOW APPEARS THAT THE THROUGH CHARGES FOR THE SHIPMENT SHOULD BE $666.99. THESE CHARGES WERE COMPUTED ON THE TRANSIT WEIGHT OF 19,475 POUNDS AT A COMMODITY RATE OF 121 CENTS PER 100 POUNDS, PLUS A MINIMUM TRANSIT CHARGE OF $18.27, PLUS CHARGES ON THE DEFICIT WEIGHT OF 10,525 POUNDS AT 121 CENTS PER 100 POUNDS TO MEET THE REQUIREMENTS OF A 30,000 POUND MINIMUM CARLOAD WEIGHT, PLUS FREIGHT CHARGES OF 479 CENTS PER 100 POUNDS, A CLASS 125 RATE, ON THE GREASE SPRAYING OUTFIT, WEIGHING 5,965 POUNDS, A DOMESTIC SHIPMENT. THE COMPUTATION IS BASED ON THE 30,000 POUND MINIMUM WEIGHT WHICH IS THE ALTERNATIVE PROVIDED IN ITEM 16373.1-B (SUPPLEMENT 233) OF THE CENTRAL TERRITORY RAILROADS TARIFF NO. 218-0, I.C.C. 4542.

ACCORDINGLY, WE HAVE INSTRUCTED OUR TRANSPORTATION DIVISION, IF OTHERWISE PROPER, TO MAKE SETTLEMENT FOR $92.03, THE BALANCE OWED ON THE OUTBOUND BILL OF LADING NO. WZ-T-368130.
