REFERENCE IS MADE TO YOUR LETTER DATED OCTOBER 8, 1959, CONCERNING YOUR INDEBTEDNESS TO THE UNITED STATES IN THE AMOUNT OF $169.31, REPRESENTING THE ERRONEOUS PAYMENT TO YOU OF $21.52 FOR FOUR DAYS' ACCRUED LEAVE, CHARGES OF $145.59 FOR 26 DAYS' EXCESS LEAVE AND $2.20 FOR ERRONEOUS PAYMENT OF LEAVE RATIONS, INCIDENT TO YOUR ENLISTED SERVICE IN THE UNITED STATES ARMY FROM SEPTEMBER 27, 1954, TO AUGUST 12, 1957.

IT IS INDICATED IN YOUR LETTER OF DECEMBER 8, 1959, THAT YOU RECEIVED FROM THE HONORABLE WILLIAM S. MAILLIARD, HOUSE OF REPRESENTATIVES, A COPY OF OUR LETTER OF AUGUST 26, 1959, TO CONGRESSMAN MAILLIARD CONCERNING THIS MATTER. THE LETTER OF AUGUST 26, 1959, SET FORTH THE BASIS FOR YOUR INDEBTEDNESS TO THE UNITED STATES AND THE REASONS WHY ACTION WOULD NOT BE PROPERLY TAKEN BY US TO RELIEVE YOU OF YOUR LIABILITY FOR SUCH INDEBTEDNESS.

YOUR PRESENT COMMUNICATION CONTAINS NO NEW OR MATERIAL EVIDENCE NOT PREVIOUSLY CONSIDERED BY US AT THE TIME THE LETTER OF AUGUST 26, 1959, WAS SENT TO CONGRESSMAN MAILLIARD. HENCE, WE HAVE NO ALTERNATIVE BUT TO ADVISE YOU THAT YOU ARE INDEBTED TO THE UNITED STATES AS SET FORTH IN THAT LETTER AND THAT WE CAN TAKE NO ACTION TO RELIVE YOU FROM THE PAYMENT OF SUCH INDEBTEDNESS.
