INC.: REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 23. WE HAVE RE-EXAMINED THE FREIGHT CHARGES PAID ON THE SHIPMENT GIVING CONSIDERATION TO THE ADDITIONAL INFORMATION PRESENTED IN YOUR LETTER. WE HAVE DETERMINED THAT WHILE YOUR COMPANY IS NOT ENTITLED TO A REFUND OF THE FULL AMOUNT CLAIMED. IT IS DUE AN ADDITIONAL AMOUNT OF $375.41 FOR THE TRANSPORTATION SERVICES RENDERED. TO ESTABLISH THAT FIGURE WE HAVE SUBTRACTED THE ADJUSTED PAYMENT OF $947.52 PREVIOUSLY ALLOWED TO YOUR COMPANY FROM THE CHARGES OF $1. 322.93 COMPUTED TO BE DUE ARE BASED ON A COMBINATION OF RATES APPLYING TO AND FROM BALTIMORE. THE MOTOR CARRIER CHARGES OF $778.32 APPLICABLE TO BALTIMORE WERE COMPUTED AT THE CLASS 55 RATING NAMED IN ITEM 2890 OF NATIONAL MOTOR FREIGHT CLASSIFICATION A-2 AND THE CLASS RATE OF $1.84 PER HUNDRED POUNDS PUBLISHED IN SOUTHERN MOTOR CARRIERS RATE CONFERENCE TARIFF 504.

REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 23, 1959, FILE 693G-3 58, REQUESTING REVIEW OF THE SETTLEMENT DATED SEPTEMBER 15, 1959, WHICH DISALLOWED YOUR RECLAIM FOR THE $544.61 WITHHELD AS OVERPAID ON THE SHIPMENT TENDERED UNDER BILL OF LADING WV 1820886 TO THE GRIGGS TRUCKING COMPANY FOR TRANSPORTATION FROM WARNER ROBBINS, GEORGIA, TO WINDSOR LOCKS, CONNECTICUT.

WE HAVE RE-EXAMINED THE FREIGHT CHARGES PAID ON THE SHIPMENT GIVING CONSIDERATION TO THE ADDITIONAL INFORMATION PRESENTED IN YOUR LETTER, AND WE HAVE DETERMINED THAT WHILE YOUR COMPANY IS NOT ENTITLED TO A REFUND OF THE FULL AMOUNT CLAIMED, IT IS DUE AN ADDITIONAL AMOUNT OF $375.41 FOR THE TRANSPORTATION SERVICES RENDERED. THE FREIGHT CHARGES OF $1,322.93 COMPUTED TO BE DUE ARE BASED ON A COMBINATION OF RATES APPLYING TO AND FROM BALTIMORE, MARYLAND, ON THE ACTUAL WEIGHT CONTAINED IN THE SHIPMENT. THE MOTOR CARRIER CHARGES OF $778.32 APPLICABLE TO BALTIMORE WERE COMPUTED AT THE CLASS 55 RATING NAMED IN ITEM 2890 OF NATIONAL MOTOR FREIGHT CLASSIFICATION A-2 AND THE CLASS RATE OF $1.84 PER HUNDRED POUNDS PUBLISHED IN SOUTHERN MOTOR CARRIERS RATE CONFERENCE TARIFF 504, MF-I.C.C. 614, SUPPLEMENTS 36 AND 50 (RATE BASIS 728). THE CHARGES OF $510.77 BEYOND BALTIMORE WERE COMPUTED BY THE SAME RATE OF $1.05 PER HUNDRED POUNDS AS USED IN THE BILLING BY THE RAIL CARRIER, WHICH IS PUBLISHED IN ITEM 1360 OF CENTRAL TERRITORY RAILROADS TARIFF E-1009, I.C.C. A-948, SUPPLEMENTS 15 AND 29 (RATE BASIS 326), PLUS THE 15 PERCENT EX-PARTE INCREASE. LOADING CHARGES OF $33.84 ALSO HAVE BEEN ALLOWED.

SETTLEMENT ON THE ABOVE BASIS, IF OTHERWISE PROPER, WILL BE ISSUED AND SHOULD REACH YOU IN DUE COURSE.
