YOUR LETTER OF JUNE 23, 1959, ADDRESSED TO THE AIR FORCE ACCOUNTING AND FINANCE CENTER, DENVER, COLORADO, AND YOUR UNDATED LETTER ADDRESSED TO THE "U S LABOR COMM. WASHINGTON D C" CONCERNING YOUR CLAIM HAVE BEEN REFERRED TO OUR OFFICE FOR DIRECT REPLY TO YOU.

THE RECORD SHOWS THAT YOU WERE EMPLOYED AT FIELSON AIR FORCE BASE, ALASKA, ON AUGUST 10, 1955, AND THAT YOU COMPLETED YOUR FIRST EMPLOYMENT AGREEMENT ON AUGUST 9, 1957. ON MARCH 24, 1958, YOU SIGNED ONE PORTION OF YOUR SECOND EMPLOYMENT AGREEMENT AND DEPARTED WITH YOUR DEPENDENTS FOR YOUR HOME IN BORGER, TEXAS, ON REEMPLOYMENT LEAVE. ON MAY 17, 1958, YOU RETURNED ALONE TO FIELSON AIR FORCE BASE AND SIGNED THE REMAINDER OF THE SECOND EMPLOYMENT AGREEMENT. YOU TERMINATED YOUR EMPLOYMENT ON DECEMBER 12, 1958, PRIOR TO COMPLETION OF ONE YEAR OF SERVICE AFTER YOUR RETURN FROM REEMPLOYMENT LEAVE, AND ARRIVED AT YOUR HOME IN BORGER, TEXAS, ON DECEMBER 20, 1958. THE RECORD SHOWS YOU TRANSPORTED 2,335 POUNDS OF HOUSEHOLD GOODS IN YOUR PICK-UP TRUCK UPON YOUR FINAL RETURN TO THE UNITED STATES.

THE ABOVE ITEMS WERE PAID YOU UNDER THE PROVISIONS OF SECTION 7 OF THE AND SECTION 27 (D) (1) OF TITLE VI, EXECUTIVE ORDER NO. 9805, AS ADDED BY BUREAU OF THE BUDGET CIRCULAR A-4, MAY 2, 1955. IT APPEARS TO BE YOUR BELIEF THAT YOUR RETURN TRAVEL UNDER ITEM C SHOULD HAVE BEEN COMPUTED UPON A MILEAGE BASIS AT THE RATE OF 10 CENTS PER MILE AS AUTHORIZED IN SPECIAL ORDER D-828 DATED DECEMBER 11, 1958.

WHILE SPECIAL ORDER D-828 AUTHORIZES YOUR RETURN FROM FIELSON AFB, ALASKA, TO BORGER, TEXAS, VIA PRIVATE AUTOMOBILE AT A MILEAGE ALLOWANCE OF 10 CENTS PER MILE, THE ORDER FURTHER PROVIDES THAT THE COST OF YOUR RETURN TRANSPORTATION "SHALL NOT EXCEED THE COST TO THE AIR FORCE BY COMMON CARRIER.' THEREFORE, REIMBURSEMENT FOR SUCH RETURN TRAVEL IS LIMITED TO THE AMOUNT IT WOULD HAVE COST THE GOVERNMENT TO RETURN YOU BY COMMON CARRIER. EXCEPT TO THE EXTENT PERMITTED BY THE MILEAGE ALLOWANCE, NOT TO EXCEED COMMON CARRIER, NO SUM WAS ALLOWABLE UNDER YOUR ORDERS IN EXCESS OF ACTUAL EXPENSES INCURRED. SINCE THIS AMOUNT WAS ALLOWED YOU BY OUR CLAIMS DIVISION IN ITEM C ABOVE, THERE IS NO FURTHER AMOUNT DUE YOU UPON THE BASIS OF THE PRESENT RECORD.
