YOU ARE OF THE OPINION THAT A REASONABLE PERIOD OF TIME ELAPSED FROM THE DATE (JANUARY 17. YOUR ATTENTION IS INVITED TO THE LETTER OF THE VETERANS ADMINISTRATION DATED JULY 13. WE ARE TODAY INSTRUCTING OUR CLAIMS DIVISION TO ALLOW THAT PORTION OF YOUR CLAIM APPLICABLE TO THE PERIOD MAY 1 THROUGH DECEMBER 31.

ON JULY 7, 1959, YOU REQUESTED RECONSIDERATION OF OUR SETTLEMENT DATED JUNE 18, 1959, WHICH DISALLOWED YOUR CLAIM FOR THE PAYMENT OF ADDITIONAL CHARGES ON ACCOUNT OF THE HOSPITALIZATION OF VETERANS ADMINISTRATION BENEFICIARIES IN STATE-OWNED HOSPITALS DURING THE CALENDAR YEAR 1958 UNDER CONTRACT NO. V 1001M-1064. YOU ARE OF THE OPINION THAT A REASONABLE PERIOD OF TIME ELAPSED FROM THE DATE (JANUARY 17, 1958) THAT YOU ADVISED THE VETERANS ADMINISTRATION THAT NEW RATES HAD BEEN ESTABLISHED AND THE DATE (JUNE 3, 1958) THAT YOU ADVISED THEM THAT BILLS FOR THE PERIOD STARTING MAY 1, 1958, WOULD BE SUBMITTED IN ACCORDANCE WITH SUCH NEW RATES. WE ACCEDE TO THAT OPINION IN THIS CASE, BUT YOUR ATTENTION IS INVITED TO THE LETTER OF THE VETERANS ADMINISTRATION DATED JULY 13, 1949, FORMALLY APPROVING CONTRACT NO. V 1001M-1064, WHICH SEEMS TO CONTEMPLATE AT LEAST SIX MONTHS NOTICE PRIOR TO THE EFFECTIVE DATE OF ANY RATE INCREASE.

ACCORDINGLY, WE ARE TODAY INSTRUCTING OUR CLAIMS DIVISION TO ALLOW THAT PORTION OF YOUR CLAIM APPLICABLE TO THE PERIOD MAY 1 THROUGH DECEMBER 31, 1958.
