REQUESTS OUR DECISION WHETHER PAYMENT IS AUTHORIZED ON MILITARY PAY ORDER NO. 3744 IN FAVOR OF STAFF SERGEANT WILLIAM S. YOU STATE FURTHER THAT SERGEANT ROACH WAS UNDER THE IMPRESSION THAT PAYMENT FOR SUBSISTENCE AS A RESULT OF THIS REQUEST WAS BEING MADE BUT THAT THE CONTRARY WAS DISCOVERED IN A ROUTINE AUDIT. TO SUBSTANTIATE SERGEANT ROACH'S CLAIM YOU HAVE ENCLOSED: 1. CERTIFICATE OF THE COMMANDER OF SERGEANT ROACH'S UNIT TO THE EFFECT THAT THE SERGEANT HAD RESIDED IN FAMILY QUARTERS SINCE HE WAS ASSIGNED TO THE UNIT. SERGEANT ROACH HAD REQUESTED AND WAS AUTHORIZED TO RATION SEPARATELY. ON THE BASIS OF THE CERTIFICATES AND SPECIAL ORDERS SUBMITTED IT MAY BE CONCLUDED THAT SERGEANT ROACH WAS AUTHORIZED TO RATION SEPARATELY WHEN HE REPORTED FOR DUTY AT HEADQUARTERS SQUADRON SECTION.

YOUR LETTER OF MARCH 19, 1959, WITH ENCLOSURES, REQUESTS OUR DECISION WHETHER PAYMENT IS AUTHORIZED ON MILITARY PAY ORDER NO. 3744 IN FAVOR OF STAFF SERGEANT WILLIAM S. ROACH FOR SUBSISTENCE ALLOWANCE.

YOU STATE THAT SERGEANT ROACH REPORTED FOR DUTY TO COMMANDER, HEADQUARTERS SECTION, 62D AIR BASE GROUP, LARSON AIR FORCE BASE, WASHINGTON, ON JANUARY 13, 1958, AND ON THAT DATE HE REQUESTED AND RECEIVED PERMISSION TO RATION SEPARATELY. YOU STATE FURTHER THAT SERGEANT ROACH WAS UNDER THE IMPRESSION THAT PAYMENT FOR SUBSISTENCE AS A RESULT OF THIS REQUEST WAS BEING MADE BUT THAT THE CONTRARY WAS DISCOVERED IN A ROUTINE AUDIT.

TO SUBSTANTIATE SERGEANT ROACH'S CLAIM YOU HAVE ENCLOSED:

1. SPECIAL ORDERS NO. A-10, HEADQUARTERS 62D AIR BASE GROUP (MATS), UNITED STATES AIR FORCE, LARSON AIR FORCE BASE, WASHINGTON, DATED FEBRUARY 10, 1959, BEARING THE ADDED LEGEND "62 ABGRU MPO #3744 11 FEB 59," PARAGRAPH 1 OF WHICH ORDERS CONFIRMS THE COMMANDER'S VERBAL ORDER OF JANUARY 13, 1958, AUTHORIZING SERGEANT ROACH TO RATION SEPARATELY;

2. CERTIFICATE OF SERGEANT ROACH STATING THAT HE SIGNED A FORM REQUESTING SEPARATE RATIONS UPON REPORTING TO HIS UNIT AND THAT HE HAS PAID FOR ALL MEALS RECEIVED IN THE MESS HALL SINCE THAT TIME;

3. CERTIFICATE OF THE COMMANDER OF SERGEANT ROACH'S UNIT TO THE EFFECT THAT THE SERGEANT HAD RESIDED IN FAMILY QUARTERS SINCE HE WAS ASSIGNED TO THE UNIT;

4. CERTIFICATE OF THE COMMANDER OF THE UNIT AT THE TIME OF SERGEANT ROACH'S ASSIGNMENT TO THE EFFECT THAT ON JANUARY 13, 1958, SERGEANT ROACH HAD REQUESTED AND WAS AUTHORIZED TO RATION SEPARATELY.

ON THE BASIS OF THE CERTIFICATES AND SPECIAL ORDERS SUBMITTED IT MAY BE CONCLUDED THAT SERGEANT ROACH WAS AUTHORIZED TO RATION SEPARATELY WHEN HE REPORTED FOR DUTY AT HEADQUARTERS SQUADRON SECTION. B-123769, JULY 18, 1955. FIVE COPIES OF THE ENCLOSURES SUBMITTED WITH YOUR LETTER ARE RETURNED. PAYMENT ON MILITARY PAY ORDER NO. 3744 FOR SUBSISTENCE ALLOWANCE AT RATE APPLICABLE WHEN PERMISSION TO MESS SEPARATELY IS GRANTED MAY BE MADE IF OTHERWISE CORRECT.
