YOU SAY YOU HAVE SOME DOUBT WHETHER AN EMPLOYEE ON TEMPORARY DUTY TRAVEL AND BEING PAID PER DIEM IN LIEU OF SUBSISTENCE MAY BE REIMBURSED FOR THE COST OF TRANSPORTATION BETWEEN PLACE OF LODGING AND PLACE OF WORK BECAUSE OUR DECISION B-126737. APPEARS TO HAVE BEEN BASED UPON THE LACK OF HOTEL FACILITIES IN THE IMMEDIATE VICINITY OF THE TEMPORARY DUTY POINT. OUR DECISION WAS BASED ENTIRELY UPON THE REVISION. IN THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS WHEREBY TRANSPORTATION AT THE TEMPORARY DUTY STATION BETWEEN PLACES OF LODGINGS AND PLACES OF DUTY WAS EXCLUDED FROM THE DEFINITION OF PER DIEM IN SECTION 6.1. THE RESULT WAS THAT SUCH TRANSPORTATION EXPENSES BECAME ALLOWABLE UNDER SECTION 3.1.

IN YOUR LETTER OF APRIL 28, 1958, YOU SAY YOU HAVE SOME DOUBT WHETHER AN EMPLOYEE ON TEMPORARY DUTY TRAVEL AND BEING PAID PER DIEM IN LIEU OF SUBSISTENCE MAY BE REIMBURSED FOR THE COST OF TRANSPORTATION BETWEEN PLACE OF LODGING AND PLACE OF WORK BECAUSE OUR DECISION B-126737, DATED MARCH 21, 1956, WHICH ALLOWED SUCH TRANSPORTATION COSTS, APPEARS TO HAVE BEEN BASED UPON THE LACK OF HOTEL FACILITIES IN THE IMMEDIATE VICINITY OF THE TEMPORARY DUTY POINT.

OUR DECISION WAS BASED ENTIRELY UPON THE REVISION, EFFECTIVE AUGUST 1, 1956, IN THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS WHEREBY TRANSPORTATION AT THE TEMPORARY DUTY STATION BETWEEN PLACES OF LODGINGS AND PLACES OF DUTY WAS EXCLUDED FROM THE DEFINITION OF PER DIEM IN SECTION 6.1. THE RESULT WAS THAT SUCH TRANSPORTATION EXPENSES BECAME ALLOWABLE UNDER SECTION 3.1, WHEN BUS OR STREETCAR IS USED. A SPECIFIC PROVISION WAS ADDED TO SECTION 3.4, WHEREBY SUCH TRANSPORTATION BY TAXICAB CAN BE AUTHORIZED OR APPROVED IF ADVANTAGEOUS TO THE GOVERNMENT.

STEPS BY THE BUREAU OF THE BUDGET TO CLARIFY THIS POINT IN THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS ARE PRESENTLY UNDER CONSIDERATION. SINCE THE PROPOSALS ARE IN ACCORD WITH OUR DECISION OF MARCH 21, 1956, WE BELIEVE THAT THE DECISION MAY BE ACCEPTED AS CONTROLLING AT THIS TIME.
