REFERENCE IS MADE TO YOUR LETTER DATED APRIL 24, 1958, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING AN ERROR TESTING MACHINES, INC., ALLEGED IT MADE ON ITS BID NO. 49621, DATED MARCH 7, 1958.

ON FEBRUARY 25, 1958, THE GOVERNMENT PRINTING OFFICE ADVERTISED FOR PRICES ON THE PURCHASE OF ONE STANDARD MOTOR DRIVEN PAPER BURSTING STRENGTH TESTER. ON MARCH 19, 1958, THE BIDS WERE OPENED AND THE FOLLOWING BIDS RECEIVED:

YOU STATE THAT WHEN THE CONTRACTING OFFICER EXAMINED THE BIDS HENOTED THAT THE BID FROM TESTING MACHINES, INC., WAS PROBABLY IN ERROR AS HE WAS AWARE THAT THEY WERE DISTRIBUTORS OF B. F. PERKINS TESTERS, WHOSE BID WAS MUCH HIGHER. BY LETTER OF APRIL 1, 1958, THE CONTRACTING OFFICER REQUESTED TESTING MACHINES, INC., TO FURNISH INFORMATION WITH REGARD TO WHAT IT PROPOSED TO FURNISH UNDER ITS BID. BY LETTER DATED APRIL 7, 1958, THE COMPANY ADVISED THE CONTRACTING OFFICER THAT THEY PROPOSED TO FURNISH THE B. F. PERKINS MULLEN TESTER, MODEL C, MOTOR DRIVEN. ALSO, IT ADVISED THAT THEY HAD MISINTERPRETED THE SPECIFICATIONS, THAT THEIR BID WAS BASED ON FURNISHING ONLY TWO OF THE FOUR GAUGES REQUIRED AND THAT THEIR BID SHOULD HAVE BEEN $74 HIGHER THAN IT WAS.

ACCORDINGLY, SINCE THE APPARENT ERROR WAS NOTICED BY THE CONTRACTING OFFICER AND, UPON REQUEST FOR VERIFICATION, THE ERROR WAS CONFIRMED AND SATISFACTORILY EXPLAINED PRIOR TO AWARD, THE BID OF TESTING MACHINES, INC., SHOULD BE DISREGARDED IN MAKING THE AWARD.

THE PAPERS, WITH THE EXCEPTION OF THE COMPANY'S LETTER OF APRIL 7, 1958, IN EXPLANATION OF THE ERROR, ARE RETURNED AS REQUESTED.
