RIUTARO OSUMI: REFERENCE IS MADE TO YOUR LETTER DATED DECEMBER 9. WHEN YOU WERE ON AUTHORIZED ANNUAL LEAVE OF ABSENCE WHILE EN ROUTE TO AND FROM THE CONTINENTAL UNITED STATES. WE HAVE RECEIVED THE ADDITIONAL INFORMATION REQUIRED IN THE CONSIDERATION OF THIS MATTER. UPON FULL CONSIDERATION OF ALL THE INFORMATION FURNISHED BY YOU AND THE ADMINISTRATIVE OFFICE WE HAVE ASCERTAINED THAT THE ORIGINAL ORDERS AUTHORIZING LEAVE-FREE TRAVEL TIME UNDER SECTION 203 (E) OF THE ANNUAL AND SICK LEAVE ACT OF 1951. WERE ISSUED IN ERROR. SUCH ORDERS WERE ADMINISTRATIVELY WITHDRAWN BECAUSE YOU HAD NO ELIGIBILITY THERETO UNDER SECTION 203 (E) OF THE LEAVE ACT. FURTHER IT HAS BEEN ASCERTAINED THAT SUCH ERROR WAS EXPLAINED TO YOU AT THE TIME OF ITS DISCOVERY WHEREUPON YOU STATED YOU WERE WELL AWARE THAT THE ENTIRE ABSENCE FROM YOUR DUTY STATION WOULD BE IN AN ANNUAL OR LEAVE WITHOUT PAY STATUS AND THAT YOU DESIRED ORDINARY ANNUAL LEAVE FOR THE ENTIRE PERIOD INVOLVED.

REFERENCE IS MADE TO YOUR LETTER DATED DECEMBER 9, 1957, AFAUD-FERO TO 230.54, 10TH INDORSEMENT, SUBMITTING NUMEROUS PAPERS CONCERNING YOUR REQUEST FOR FREE-TRAVEL TIME OF 16 1/2 DAYS DURING THE PERIOD AUGUST 9 TO OCTOBER 9, 1957, WHEN YOU WERE ON AUTHORIZED ANNUAL LEAVE OF ABSENCE WHILE EN ROUTE TO AND FROM THE CONTINENTAL UNITED STATES. WE HAVE RECEIVED THE ADDITIONAL INFORMATION REQUIRED IN THE CONSIDERATION OF THIS MATTER.

SUCH ORDERS WERE ADMINISTRATIVELY WITHDRAWN BECAUSE YOU HAD NO ELIGIBILITY THERETO UNDER SECTION 203 (E) OF THE LEAVE ACT. FURTHER IT HAS BEEN ASCERTAINED THAT SUCH ERROR WAS EXPLAINED TO YOU AT THE TIME OF ITS DISCOVERY WHEREUPON YOU STATED YOU WERE WELL AWARE THAT THE ENTIRE ABSENCE FROM YOUR DUTY STATION WOULD BE IN AN ANNUAL OR LEAVE WITHOUT PAY STATUS AND THAT YOU DESIRED ORDINARY ANNUAL LEAVE FOR THE ENTIRE PERIOD INVOLVED.

UPON THE PRESENT RECORD WE FIND NO BASIS FOR FAVORABLE ACTION ON YOUR REQUEST FOR ALLOWANCE OF TRAVEL TIME WITHOUT CHARGE TO YOUR LEAVE ACCOUNT.
