UPON COMPLETION OF WHICH HE WAS TO RETURN TO HIS PERMANENT STATION. THE CLAIM IS PRESENTED UNDER PARAGRAPH 4401. WHICH PROVIDES THAT REIMBURSEMENT IS AUTHORIZED FOR TRAVEL BY TAXICAB BETWEEN PLACES OF ABODE OR LODGING. PROVIDES THAT MEMBERS ON DUTY WITH THE MILITARY AIR TRANSPORT SERVICE WHILE AWAY FROM THEIR PERMANENT STATION ARE AUTHORIZED PER DIEM ALLOWANCES AS CONTAINED IN CHAPTER 4. ARE AUTHORIZED PER DIEM ALLOWANCES AS CONTAINED IN THE SAID PARTS E AND F OF CHAPTER 4 WITHOUT THE ISSUANCE OF ORDERS FOR SPECIFIC TRAVEL. IS MADE. THERE HAS BEEN CONSIDERED YOUR LETTER OF OCTOBER 21, 1957, FORWARDED HERE BY THE DIRECTOR OF ACCOUNTING AND FINANCE BY LETTER DATED DECEMBER 9, 1957, REQUESTING DECISION WHETHER PAYMENT MAY BE MADE ON A SUBMITTED SUPPLEMENTAL VOUCHER STATED IN FAVOR OF FIRST LIEUTENANT ROBERT E. DELONG, USAF.

THE VOUCHER IS IN THE AMOUNT OF $4.50, REPRESENTING REIMBURSEMENT FOR TAXI FARE FROM THE OFFICER'S HOME, MOUNT HOLLY, NEW JERSEY, TO HIS PERMANENT STATION, MCGUIRE AIR FORCE BASE, NEW JERSEY. THE TRAVEL WAS PERFORMED BY HIM IN ORDER TO CARRY OUT HIS ASSIGNED MISSION UNDER PARAGRAPH 1, FLIGHT ORDER NO. 608, DATED OCTOBER 9, 1957. THESE ORDERS REQUIRED THE MEMBER, A TRANSPORT PILOT, TO PERFORM A REGULARLY SCHEDULED MILITARY AIR TRANSPORT SERVICE FLIGHT FROM MCGUIRE AIR FORCE BASE, NEW JERSEY, TO THULE AIR FORCE BASE, GREENLAND, UPON COMPLETION OF WHICH HE WAS TO RETURN TO HIS PERMANENT STATION.

THE CLAIM IS PRESENTED UNDER PARAGRAPH 4401, JOINT TRAVEL REGULATIONS, WHICH PROVIDES THAT REIMBURSEMENT IS AUTHORIZED FOR TRAVEL BY TAXICAB BETWEEN PLACES OF ABODE OR LODGING, PLACE OF DUTY AT THE PERMANENT OR TEMPORARY DUTY STATION AND AIRPORTS OR OTHER CARRIER TERMINAL OF THE MODE OF COMMERCIAL OR GOVERNMENT TRANSPORTATION USED. YOU STATE THAT DOUBT IN THIS MATTER ARISES FROM THE FACT THAT PARAGRAPH 5150, JOINT TRAVEL REGULATIONS, PROVIDES THAT MEMBERS ON DUTY WITH THE MILITARY AIR TRANSPORT SERVICE WHILE AWAY FROM THEIR PERMANENT STATION ARE AUTHORIZED PER DIEM ALLOWANCES AS CONTAINED IN CHAPTER 4, PARTS E AND F, WITHOUT ORDERS FOR SPECIFIC TRAVEL, BUT DOES NOT INDICATE AUTHORITY FOR PAYMENT OF REIMBURSABLE EXPENSES.

PARTS E AND F OF CHAPTER 4 OF THE JOINT TRAVEL REGULATIONS PROVIDE FOR THE PAYMENT OF PER DIEM TO MEMBERS OF THE UNIFORMED SERVICES FOR ALL PERIODS OF TRAVEL AND TEMPORARY DUTY UNDER COMPETENT ORDERS IN THE UNITED STATES AND OUTSIDE THE UNITED STATES, RESPECTIVELY, EXCEPT UNDER THE CIRCUMSTANCES SET FORTH UNDER THOSE PARTS. IT APPEARS, HOWEVER, THAT CERTAIN MEMBERS WHOSE REGULARLY ASSIGNED DUTY CONSISTS OF PERFORMING SCHEDULED FLIGHTS FROM A PERMANENT STATION TO SOME OTHER POINT AND RETURN, NORMALLY WOULD NOT BE CONSIDERED AS PERFORMING TRAVEL AND TEMPORARY DUTY AS CONTEMPLATED BY PARTS E AND F OF CHAPTER 4. THEREFORE, THE JOINT TRAVEL REGULATIONS PROVIDE (PARAGRAPH 5150) THAT MEMBERS ON DUTY WITH OR UNDER TRAINING FOR THE MILITARY AIR TRANSPORT SERVICE, MARINE CORPS TRANSPORT SQUADRONS, OR FLEET LOGISTIC AIR WINGS, WHILE AWAY FROM THEIR PERMANENT STATION, ARE AUTHORIZED PER DIEM ALLOWANCES AS CONTAINED IN THE SAID PARTS E AND F OF CHAPTER 4 WITHOUT THE ISSUANCE OF ORDERS FOR SPECIFIC TRAVEL. NO PROVISION, HOWEVER, IS MADE, NOR DOES THERE APPEAR TO BE AUTHORITY TO INCLUDE IN THE JOINT TRAVEL REGULATIONS A PROVISION, FOR REIMBURSING SUCH MEMBERS FOR THE EXPENSE OF TRAVELING FROM HOME OR PLACE OF ABODE TO THE PLACE AT WHICH THEY REPORT FOR THEIR REGULAR DUTY. THERE IS NOT AUTHORITY FOR PAYMENT ON THE SUBMITTED VOUCHER WHICH WILL BE RETAINED HERE.
