(3) A SMALL BUSINESS CONCERN WHICH IS NOT LOCATED IN A LABOR SURPLUS AREA. YOU ARE ADVISED THAT WE HAVE NO OBJECTION TO THE ISSUANCE OF THE PROPOSED REGULATION.

YOUR LETTER OF OCTOBER 25, 1957, FORWARDED FOR OUR REVIEW COPIES OF A PROPOSED GENERAL SERVICES ADMINISTRATION REGULATION, ENTITLED "EQUAL BIDS, MAKING OF AWARDS," WHICH WOULD BE ISSUED IN FURTHERANCE OF THE GOVERNMENT'S POLICIES TO ENCOURAGE THE PLACEMENT OF CONTRACTS AND FACILITIES IN AREAS OF CURRENT OR IMMINENT LABOR SURPLUS, AND TO PLACE A FAIR SHARE OF THE GOVERNMENT'S TOTAL PURCHASES AND CONTRACTS WITH SMALL BUSINESS CONCERNS.

THE REGULATION WOULD REQUIRE THAT AWARD BE MADE TO THE EQUAL BIDDER (IF ITS BID IS OTHERWISE ACCEPTABLE) IN THE HIGHEST CATEGORY AS DETERMINED FROM THE FOLLOWING: (1) A SMALL BUSINESS CONCERN LOCATED IN A LABOR SURPLUS AREA; (2) A CONCERN, OTHER THAN A SMALL BUSINESS CONCERN, LOCATED IN A LABOR SURPLUS AREA; (3) A SMALL BUSINESS CONCERN WHICH IS NOT LOCATED IN A LABOR SURPLUS AREA; AND (4) ALL OTHER. IN THE EVENT THAT THE HIGHEST CATEGORY INVOLVED APPLIES TO MORE THAN ONE EQUAL BIDDER, THE REGULATION WOULD REQUIRE THE AWARD TO BE MADE BY LOT LIMITED TO THE EQUAL BIDDERS IN THAT CATEGORY.

YOU ARE ADVISED THAT WE HAVE NO OBJECTION TO THE ISSUANCE OF THE PROPOSED REGULATION.
