WHO IS CLAIMING REIMBURSEMENT OF EXPENSES INCURRED BY HIM FOR THE TRANSPORTATION OF HIS WIFE FROM WICHITA. THIS MATTER WAS THE SUBJECT OF OUR LETTER OF NOVEMBER 7. HINDE WAS INITIALLY APPOINTED FOR OVERSEAS DUTY IN JAPAN EFFECTIVE FEBRUARY 16. HINDE WAS AUTHORIZED TRAVEL EXPENSES INCIDENT TO A PERMANENT CHANGE OF STATION TO HAWAII. HINDE'S CLAIM WAS PREVIOUSLY DISALLOWED BECAUSE THE TRANSPORTATION AND TRAVEL INVOLVED WAS NOT ADMINISTRATIVELY AUTHORIZED OR APPROVED AND WAS NOT PERFORMED UNTIL AFTER THE EXPIRATION OF THE TWO-YEAR TIME LIMITATION OF SECTION 5 OF EXECUTIVE ORDER NO. 9805. UNDERSTAND THAT THE DEPARTMENT OF THE AIR FORCE IS AGREEABLE TO FAVORABLE ACTION AND TO SETTLEMENT OF THE CLAIM LOCALLY BY HEADQUARTERS.

THIS REFERS TO THE CLAIM OF MR. ROBERT R. HINDE, AN EMPLOYEE OF THE AIR FORCE, WHO IS CLAIMING REIMBURSEMENT OF EXPENSES INCURRED BY HIM FOR THE TRANSPORTATION OF HIS WIFE FROM WICHITA, KANSAS, TO HONOLULU, T.H., AND FOR THE SHIPMENT, INCLUDING TRANSFER AND STORAGE CHARGES, OF HIS HOUSEHOLD EFFECTS FROM SALINA, KANSAS, TO HONOLULU, T.H., DURING THE PERIOD JULY TO SEPTEMBER 1956. THIS MATTER WAS THE SUBJECT OF OUR LETTER OF NOVEMBER 7, 1957, TO YOU, AND REPLY OF JANUARY 21, 1958, FROM MR. FLOYD VAN DOMELEN, CHIEF, STANDARDS DIVISION, DIRECTORATE OF CIVILIAN PERSONNEL.

MR. HINDE WAS INITIALLY APPOINTED FOR OVERSEAS DUTY IN JAPAN EFFECTIVE FEBRUARY 16, 1952. AT THIS TIME HE EXECUTED A TWENTY-FOUR MONTH EMPLOYMENT AGREEMENT. HE ARRIVED AT HIS DUTY STATION FEBRUARY 23, 1952. SUBSEQUENTLY, MR. HINDE WAS AUTHORIZED TRAVEL EXPENSES INCIDENT TO A PERMANENT CHANGE OF STATION TO HAWAII. THE TRAVEL ORDER, DATED MAY 23, 1956, AUTHORIZED MOVEMENT OF NOT TO EXCEED 3,125 POUNDS OF HOUSEHOLD EFFECTS FROM JAPAN TO HAWAII. MR. HINDE'S CLAIM WAS PREVIOUSLY DISALLOWED BECAUSE THE TRANSPORTATION AND TRAVEL INVOLVED WAS NOT ADMINISTRATIVELY AUTHORIZED OR APPROVED AND WAS NOT PERFORMED UNTIL AFTER THE EXPIRATION OF THE TWO-YEAR TIME LIMITATION OF SECTION 5 OF EXECUTIVE ORDER NO. 9805. UNDERSTAND THAT THE DEPARTMENT OF THE AIR FORCE IS AGREEABLE TO FAVORABLE ACTION AND TO SETTLEMENT OF THE CLAIM LOCALLY BY HEADQUARTERS, PACIFIC AIR FORCES.

UPON REVIEW OF THIS MATTER IT NOW APPEARS THAT MR. HINDE HAS AN ENTITLEMENT FOR TRANSPORTATION OF HIS WIFE AND HOUSEHOLD EFFECTS,INCLUDING TRANSFER AND TEMPORARY STORAGE CHARGES, IF OTHERWISE PROPER, BECAUSE OF HIS PERMANENT CHANGE OF STATION FROM JAPAN TO HAWAII IN MAY OF 1956 AND THE ADMINISTRATIVE APPROVAL OF THE TRANSPORTATION EXPENSES INCURRED INCIDENT THERETO. IN THIS REGARD EXECUTIVE ORDER NO. 10196, SECTION 8, DATED DECEMBER 20, 1950, WHICH AMENDED EXECUTIVE ORDER NO. 9805, PROVIDES THAT "THE EXPENSE OF TRANSPORTATION AUTHORIZED HEREUNDER * * * SHALL BE ALLOWABLE WHETHER THE SHIPMENT ORIGINATES AT THE EMPLOYEE'S LAST OFFICIAL STATION OR AT SOME OTHER POINT * * *.' SEE ALSO SECTION 3 OF EXECUTIVE ORDER NO. 10196. THESE SECTIONS PROVIDE, HOWEVER, THAT THE COST OF THE TRANSPORTATION OF DEPENDENTS AND HOUSEHOLD EFFECTS SHALL NOT EXCEED THE COST BY A USUALLY TRAVELED ROUTE BETWEEN THE LAST OFFICIAL STATION AND THE NEW OFFICIAL STATION.

THEREFORE, MR. HINDE'S CLAIM FOR TRANSPORTATION, INCLUDING STORAGE AND TRANSFER CHARGES, OF HIS HOUSEHOLD EFFECTS AND HIS DEPENDENT FROM THE UNITED STATES TO HAWAII ARE NOW FOR PAYMENT, IF OTHERWISE PROPER. TRANSPORTATION COSTS ALLOWABLE, HOWEVER, MAY NOT EXCEED THE COSTS THAT WOULD HAVE BEEN INCURRED HAD THEIR TRANSPORTATION BEEN MADE FROM HIS OLDSTATION, HEADQUARTERS FAR EAST AIR FORCE, TOKYO, JAPAN, TO HIS NEW STATION, HEADQUARTERS FAR EAST AIR FORCE (REAR) HICKAM AIR FORCE BASE, T.H. WE HAVE NO OBJECTION TO THE CLAIM BEING SETTLED LOCALLY BY HEADQUARTERS, PACIFIC AIR FORCES.

THE NECESSARY PAPERS AND BILLS OF LADING ARE ENCLOSED FOR YOUR USE IN THE SETTLEMENT OF THE CLAIM.
