REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 10, 1957, REQUESTING REVIEW OF OUR SETTLEMENT DATED JUNE 3, 1957, WHICH DISALLOWED YOUR CLAIM FOR $77.60 AS REIMBURSEMENT FOR CERTAIN EXPENSES INCURRED INCIDENT TO TRAVEL AUTHORIZED BY FIRST INDORSEMENT OF DECEMBER 20, 1956, ON YOUR ORDERS DATED OCTOBER 19, 1956, DIRECTING YOUR PERMANENT CHANGE OF STATION FROM PARIS, FRANCE, TO FASRON 104, PORT LYAUTEY, FRENCH MOROCCO.

BY THE ORDERS DATED OCTOBER 19, 1956, AS AMENDED, YOU WERE AUTHORIZED TO TRAVEL TO PORT LYAUTEY, MOROCCO, BY WAY OF OBERAMMERGAU, GERMANY, BY PRIVATELY OWNED AUTOMOBILE. THESE ORDERS FURTHER PURPORTED TO AUTHORIZE PER DIEM BASED ON THE DATE REQUIRED TO REACH YOUR NEW STATION BY THE MOST DIRECT USUALLY TRAVELED ROUTE. IT APPEARS THAT YOU HAVE BEEN PAID BOTH MILEAGE AND PER DIEM FOR THE TRAVEL. THE VOUCHER PRESENTED COVERS THE COST OF AN ENTRY PERMIT INTO SPAIN AND FERRY PASSAGE, FROM GIBRALTER TO TANGIER, INCIDENT THERETO.

SECTION 303 (A) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 813, THE STATUTORY AUTHORITY FOR PAYMENT OF TRAVEL AND TRANSPORTATION ALLOWANCES TO MEMBERS OF THE UNIFORMED SERVICES, PROVIDES FOR PAYMENT OF THE MILEAGE ALLOWANCE "IN LIEU OF COST OF TRANSPORTATION.' THE TRAVEL ALLOWANCES PAYABLE INCIDENT TO A PERMANENT CHANGE OF STATION ARE SET FORTH IN CHAPTER 4, PART D OF THE JOINT TRAVEL REGULATIONS, PARAGRAPHS 4150 AND 4159 OF WHICH PROVIDE THAT REIMBURSEMENT ON A MILEAGE BASIS IN SUCH CASES SHALL BE AT THE RATE OF 6 CENTS A MILE. IT CONSISTENTLY HAS BEEN HELD, 34 COMP. GEN. 530, ID. 531, 532, AND, ALSO, PARAGRAPH 4401 OF THE JOINT TRAVEL REGULATIONS, THAT FERRY FARES, ETC., "ARE NOT REIMBURSABLE IN ADDITION TO THE (THIS) MONETARY ALLOWANCE IN LIEU OF TRANSPORTATION.' IT FOLLOWS THAT YOUR CLAIM FOR ACTUAL EXPENSES MAY NOT BE ALLOWED IN ADDITION TO THE MILEAGE ALLOWANCE.

ACCORDINGLY, THE SETTLEMENT OF JUNE 3, 1957, IS SUSTAINED. FURTHER, THE ADDITIONAL 1 CENT A MILE, OR $20.98, AND PER DIEM IN THE AMOUNT OF $68.40 HERETOFORE PAID TO YOU, A TOTAL OF $89.38, CONSTITUTE AN OVERPAYMENT WHICH YOU ARE REQUIRED TO REFUND.

WHILE THE RECEIPTS FURNISHED WITH YOUR CLAIM MAY NOT BE RETURNED, COPIES THEREOF ARE ENCLOSED.
