THERE HAS BEEN SUBMITTED FOR OUR CONSIDERATION LETTERS OF YOUR AGENCY DATED JULY 26 AND NOVEMBER 6, 1957 (FILE NO. 141B), SIGNED BY MR. SAM J. CLARK, DIRECTOR, AUDIT AND ACCOUNTING SERVICE, DEPARTMENT OF MEDICINE AND SURGERY, CONCERNING THE POSSIBLE INDEBTEDNESS OF MR. HENRY STANO, AN EMPLOYEE OF THE VETERANS ADMINISTRATION, INCIDENT TO HIS ACCEPTANCE OF A PHYSICAL THERAPY TRAVELSHIP FROM THE NATIONAL FOUNDATION FOR INFANTILE PARALYSIS REQUIRING TRAVEL TO VARIOUS EUROPEAN COUNTRIES TO STUDY REHABILITATION CENTERS FROM SEPTEMBER 4 TO NOVEMBER 30, 1956. THE DOUBT AS TO THE PROPRIETY OF PAYMENTS OF A MAINTENANCE ALLOWANCE AND TRANSPORTATION EXPENSES TO MR. STANO BY THE FOUNDATION CONCURRENTLY WITH HIS SALARY AROSE BECAUSE OF THE PROVISIONS OF 18 U.S.C. 1914 AS APPLIED IN OUR DECISION DATED AUGUST 23, 1956, 36 COMP. GEN. 155 TO RECIPIENTS OF ROCKEFELLER PUBLIC SERVICE AWARDS.

SINCE WE UNDERSTAND MR. STANO COMMENCED HIS STUDY BEFORE YOUR AGENCY RECEIVED NOTICE OF OUR DECISION AND IN VIEW OF THE THEN PREVAILING UNCERTAINTY AS TO THE APPLICATION OF 18 U.S.C. 1914 TO PHILANTHROPIC GRANTS, OUR OFFICE WILL INTERPOSE NO OBJECTION TO DISCONTINUANCE OF FURTHER COLLECTION OR ADJUSTMENT ACTION IN MR. STANO'S CASE CONCERNING HIS SALARY, GRANT FUNDS, OR HIS LEAVE ACCOUNT FOR THE PERIOD INVOLVED.
