USMC: FURTHER REFERENCE IS MADE TO YOUR LETTER OF AUGUST 3. YOU WERE DIRECTED TO PROCEED TO WASHINGTON. YOUR CLAIM FOR REIMBURSEMENT WAS DISALLOWED BY THE SETTLEMENT MENTIONED ABOVE. THE LOWEST ENLISTED GRADE FOR WHICH SHIPMENT OF HOUSEHOLD EFFECTS IS AUTHORIZED UPON PERMANENT CHANGE OF STATION IS E 4 WITH OVER FOUR YEARS' SERVICE. WHEN THE CHANGE OF STATION ORDERS WERE ISSUED. YOU WERE A PRIVATE FIRST CLASS (GRADE E-2) THERE WAS NO AUTHORITY FOR SHIPMENT OF YOUR EFFECTS. ASIDE FROM THE FACT THAT YOU HAVE FURNISHED NO EVIDENCE OF THE COST INCURRED. THERE IS NO BASIS FOR THE ALLOWANCE OF YOUR CLAIM. THE DISALLOWANCE OF YOUR CLAIM IS SUSTAINED.

FURTHER REFERENCE IS MADE TO YOUR LETTER OF AUGUST 3, 1957, REQUESTING REVIEW OF THE SETTLEMENT OF JULY 26, 1957, WHICH DISALLOWED YOUR CLAIM FOR REIMBURSEMENT FOR THE COST OF MOVING YOUR HOUSEHOLD EFFECTS BY TRAILER FROM SAN FRANCISCO, CALIFORNIA, TO WASHINGTON, D.C., AUGUST 25 TO SEPTEMBER 5, 1956.

BY ORDERS DATED SEPTEMBER 21, 1955, HAVING ENLISTED IN THE MARINE CORPS AS A PRIVATE FIRST CLASS AT SAN FRANCISCO, CALIFORNIA, YOU WERE DIRECTED TO PROCEED TO WASHINGTON, D.C., FOR DUTY WITH THE U.S. MARINE BAND. YOU HAULED YOUR HOUSEHOLD EFFECTS FROM SAN FRANCISCO TO WASHINGTON IN THE TRAILER DURING THE PERIOD AUGUST 25 TO SEPTEMBER 5, 1956. YOUR CLAIM FOR REIMBURSEMENT WAS DISALLOWED BY THE SETTLEMENT MENTIONED ABOVE, IT BEING STATED THAT YOU HAD NOT FURNISHED EVIDENCE OF THE COST INCURRED IN MAKING THE SHIPMENT.

SECTION 303 (C) OF THE CAREER COMPENSATION ACT OF 1949, AS AMENDED, 37 U.S.C. 253, PROVIDES THAT UNDER SUCH CONDITIONS AND LIMITATIONS AND FOR SUCH RANKS, GRADES, OR RATINGS, AND TO OR FROM SUCH LOCATIONS AS MAY BE PRESCRIBED BY THE SECRETARIES CONCERNED, MEMBERS OF THE UNIFORMED SERVICES WHEN ORDERED TO MAKE A CHANGE OF STATION SHALL BE ENTITLED TO TRANSPORTATION OF HOUSEHOLD EFFECTS OR TO REIMBURSEMENT THEREFOR. JOINT TRAVEL REGULATIONS PROMULGATED BY THE SECRETARIES PURSUANT TO THOSE PROVISIONS DO NOT AUTHORIZE SHIPMENT OF HOUSEHOLD EFFECTS FOR A MEMBER IN GRADE E-2. EXCEPT FOR A SMALL ALLOWANCE FOR AVIATION CADETS, THE LOWEST ENLISTED GRADE FOR WHICH SHIPMENT OF HOUSEHOLD EFFECTS IS AUTHORIZED UPON PERMANENT CHANGE OF STATION IS E 4 WITH OVER FOUR YEARS' SERVICE. SINCE, WHEN THE CHANGE OF STATION ORDERS WERE ISSUED, YOU WERE A PRIVATE FIRST CLASS (GRADE E-2) THERE WAS NO AUTHORITY FOR SHIPMENT OF YOUR EFFECTS. THUS, ASIDE FROM THE FACT THAT YOU HAVE FURNISHED NO EVIDENCE OF THE COST INCURRED, THERE IS NO BASIS FOR THE ALLOWANCE OF YOUR CLAIM. THEREFORE, THE DISALLOWANCE OF YOUR CLAIM IS SUSTAINED.
