VETERANS ADMINISTRATION: REFERENCE IS MADE TO A LETTER DATED JULY 26. ALLEGES WAS MADE IN ITS BID OPENED ON JUNE 12. THAT AN ERROR HAD BEEN MADE IN ITS BID IN THAT IT HAD FAILED TO SURVEY ALL OF THE BUILDINGS THAT WERE TO BE SERVICED AND FAILED TO INCLUDE IN ITS BID PRICE THE COST OF WASHING THE SCREENS. IT HAS NOT BEEN ESTABLISHED THAT THE INTENDED BID PRICE FOR THE WORK WAS $10. SINCE IT WAS BELIEVED THAT THE BID OF THE VETERANS WINDOW CLEANING COMPANY WAS ERRONEOUS. SINCE SUCH BELIEF WAS CONFIRMED AND THE ERROR WAS EXPLAINED BY THE BIDDER PRIOR TO AWARD. SUCH QUESTION IS ANSWERED IN THE AFFIRMATIVE.

REFERENCE IS MADE TO A LETTER DATED JULY 26, 1957, WITH ENCLOSURES, FROM THE DEPUTY ADMINISTRATOR, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING AN ERROR WHICH THE VETERANS WINDOW CLEANING COMPANY, EAST CLEVELAND 12, OHIO, ALLEGES WAS MADE IN ITS BID OPENED ON JUNE 12, 1957.

THE VETERANS ADMINISTRATION CENTER, DAYTON, OHIO, BY INVITATION NO. 58-9, REQUESTED BIDS FOR FURNISHING WINDOW CLEANING SERVICES IN VARIOUS BUILDINGS DURING THE PERIOD BEGINNING JULY 1, 1957, AND ENDING JUNE 30, 1958. THE SPECIFICATIONS PROVIDE THAT THE ENUMERATED SERVICES WOULD BE PERFORMED TWO TIMES DURING THE FISCAL YEAR 1958, IN SEPTEMBER 1957, AND IN MARCH 1958. IN RESPONSE THE VETERANS WINDOW CLEANING COMPANY SUBMITTED A BID OFFERING TO PERFORM THE REQUIRED SERVICES FOR THE JOB PRICE OF $5,660. THE TWO OTHER BIDDERS ON THE WORK QUOTED JOB PRICES OF $15,000 AND $15,347.10.

UPON BEING REQUESTED TO VERIFY ITS BID PRICE, THE VETERANS WINDOW CLEANING COMPANY ADVISED, BY LETTER DATED JUNE 21, 1957, THAT AN ERROR HAD BEEN MADE IN ITS BID IN THAT IT HAD FAILED TO SURVEY ALL OF THE BUILDINGS THAT WERE TO BE SERVICED AND FAILED TO INCLUDE IN ITS BID PRICE THE COST OF WASHING THE SCREENS. THE COMPANY STATED THAT IT WISHED TO SUBMIT A REVISED BID OF $5,242 FOR ONE CLEANING AND OF $10,484 FOR TWO CLEANINGS. BY LETTER DATED JULY 12, 1957, THE COMPANY SUBMITTED ITS ORIGINAL AND REVISED ESTIMATE SHEETS. ALTHOUGH THERE APPEARS NO DOUBT THAT THE VETERANS WINDOW CLEANING COMPANY MADE AN ERROR IN QUOTING A JOB PRICE OF $5,660 FOR THE WORK, IT HAS NOT BEEN ESTABLISHED THAT THE INTENDED BID PRICE FOR THE WORK WAS $10,484. SEE 17 COMP. GEN. 575.

ACCORDINGLY, SINCE IT WAS BELIEVED THAT THE BID OF THE VETERANS WINDOW CLEANING COMPANY WAS ERRONEOUS, AND SINCE SUCH BELIEF WAS CONFIRMED AND THE ERROR WAS EXPLAINED BY THE BIDDER PRIOR TO AWARD, THE BID OF THE COMPANY SHOULD BE DISREGARDED.

REGARDING THE QUESTION AS TO WHETHER THE TWO OTHER BIDS ON THE WORK MAY BE REJECTED AND THE WORK READVERTISED, IN VIEW OF THE DIFFERENCE BETWEEN THE ALLEGED INTENDED BID OF THE VETERANS WINDOW CLEANING COMPANY AND THE OTHER BIDS, SUCH QUESTION IS ANSWERED IN THE AFFIRMATIVE.
