JR.: FURTHER REFERENCE IS MADE TO YOUR LETTER OF MAY 8. YOU WERE TRANSFERRED ON PERMANENT CHANGE OF STATION TO HEADQUARTERS AND HEADQUARTERS SQUADRON. YOU WERE TRANSFERRED (FROM WASHINGTON. ADDITIONAL ORDERS APPARENTLY WERE ISSUED EXTENDING THE TEMPORARY DUTY BY 30 DAYS. OUR AUDITORS TOOK EXCEPTION TO PAYMENTS MADE TO YOU ON ACCOUNT OF DEPENDENT TRAVEL ALLEGED TO HAVE BEEN PERFORMED BETWEEN WASHINGTON. THUS INDICATING THAT THE TRAVEL WAS NOT PERFORMED AS CLAIMED. OR IF IT WAS PERFORMED THERE WAS NO INTENT OF ESTABLISHING A BONA FIDE RESIDENCE AS REQUIRED BY THE JOINT TRAVEL REGULATIONS. THE EXCEPTIONS TAKEN AGAINST THOSE PAYMENTS HAVE BEEN REMOVED. FURTHER REFERENCE IS MADE TO YOUR LETTER OF MAY 8, 1957, CONCERNING YOUR INDEBTEDNESS AS TO THE UNITED STAES ON ACCOUNT OF TWO PAYMENTS MADE FOR YOUR DEPENDENT TRAVEL ($150.60 AND $163.02) AND PAYMENT FOR EXCESS ACCRUED LEAVE ($258.52) WHILE SERVING AS AN OFFICER IN THE UNITED STATES AIR FORCE.

IT APPEARS FROM THE RECORDS BEFORE US THAT BY SPECIAL ORDERS DATED JANUARY 20, 1951, CONNALLY AIR FORCE BASE, TEXAS, YOU WERE TRANSFERRED ON PERMANENT CHANGE OF STATION TO HEADQUARTERS AND HEADQUARTERS SQUADRON, AIR RESCUE SERVICE, WASHINGTON, D.C. BY ORDERS DATED MAY 9, 1951, YOU WERE TRANSFERRED (FROM WASHINGTON, D.C.) ON PERMANENT CHANGE OF STATION TO MOUNTAIN HOME AIR FORCE BASE, IDAHO, WITH 60 DAYS TEMPORARY DUTY EN ROUTE AT NEW YORK. ADDITIONAL ORDERS APPARENTLY WERE ISSUED EXTENDING THE TEMPORARY DUTY BY 30 DAYS.

OUR AUDITORS TOOK EXCEPTION TO PAYMENTS MADE TO YOU ON ACCOUNT OF DEPENDENT TRAVEL ALLEGED TO HAVE BEEN PERFORMED BETWEEN WASHINGTON, D.C., AND BOISE, IDAHO, AND FROM THE LATTER PLACE TO NEW HAVEN, CONNECTICUT, SINCE THE RECORDS THEN BEFORE OUR OFFICE, NME FORM 137, DATED SEPTEMBER 1951, SHOWED YOUR DEPENDENTS' ADDRESS AS NEW HAVEN, CONNECTICUT, THUS INDICATING THAT THE TRAVEL WAS NOT PERFORMED AS CLAIMED, OR IF IT WAS PERFORMED THERE WAS NO INTENT OF ESTABLISHING A BONA FIDE RESIDENCE AS REQUIRED BY THE JOINT TRAVEL REGULATIONS.

IN YOUR LETTER OF MAY 8, 1957, YOU STATE THAT YOUR DEPENDENTS ACCOMPANIED YOU TO BOISE, IDAHO, IN SEPTEMBER 1951, AND REMAINED THERE WITH YOU UNTIL YOUR RELEASE FROM ACTIVE DUTY ON JANUARY 16, 1952. WITH YOUR LETTER YOU ENCLOSED A PHOTOSTATIC COPY OF YOUR PERSONAL CHECK DATED OCTOBER 3, 1951, NEGOTIATED AT BOISE, IDAHO, WHICH YOU SAY REPRESENTS PAYMENT OF TWO WEEKS' RENT FOR AN APARTMENT OCCUPIED BY YOU AND YOUR FAMILY. ON THAT BASIS, WE NOW CONCLUDE THAT YOUR DEPENDENTS ESTABLISHED A BONA FIDE RESIDENCE AT BOISE, IDAHO, AND THAT YOUR DEPENDENTS ACTUALLY TRAVELED FROM BOISE, IDAHO, TO NEW HAVEN, CONNECTICUT, INCIDENT TO YOUR RELEASE FROM ACTIVE DUTY. THE EXCEPTIONS TAKEN AGAINST THOSE PAYMENTS HAVE BEEN REMOVED.

CONCERNING THE PAYMENT OF EXCESS ACCRUED LEAVE UPON YOUR RELEASE FROM ACTIVE DUTY, OUR AUDITORS TOOK EXCEPTION TO 18 OF THE 43 DAYS' ACCRUED LEAVE PAYMENT ON THE BASIS OF THE RECORDS THEN AVAILABLE. SINCE THE ABOVE ORDERS OF JANUARY 20, 1951, AUTHORIZED DELAY EN ROUTE AND SINCE YOUR PAY RECORD SHOWED THAT YOU DEPARTED CONNALLY AIR FORCE BASE, TEXAS, ON JANUARY 20, 1951, AND ARRIVED IN WASHINGTON, D.C., ON JANUARY 29, 1951, THE EXCESS TRAVEL TIME INDICATED YOU AVAILED YOURSELF OF THREE DAYS' DELAY EN ROUTE. ALSO, SINCE THE ABOVE ORDERS OF MAY 9, 1951, AUTHORIZED 15 DAYS' DELAY EN ROUTE UPON COMPLETION OF TEMPORARY DUTY AT NEW YORK, IT WAS ASSUMED THAT YOU AVAILED YOURSELF OF THE 15 DAYS. ON THE BASIS THAT YOU USED THE 18 DAYS AUTHORIZED IN THE ORDERS, AND SINCE THE LEAVE WHICH ACCRUED TO YOU DURING THE PERIOD OF YOUR SERVICE FROM AUGUST 17, 1950, TO JANUARY 16, 1952, AMOUNTED TO 43 DAYS, IT APPEARED THAT YOU WERE ENTITLED ONLY TO PAYMENT FOR 25 DAYS' ACCRUED LEAVE AT THE TIME OF YOUR RELEASE FROM ACTIVE DUTY. IT NOW APPEARS FROM THE RECORD THAT NO LEAVE WAS TAKEN BY YOU INCIDENT TO YOUR REPORTING TO YOUR DUTY STATION AT WASHINGTON, D.C., AND THE ITINERARY ATTACHED TO VOUCHER 3916 IN THE SEPTEMBER 1951 ACCOUNTS OF R. R. SHAULIS DISCLOSES THAT NO LEAVE WAS TAKEN INCIDENT TO YOUR TRAVEL FROM NEW YORK, NEW YORK, TO MOUNTAIN HOME AIR FORCE BASE, IDAHO, DURING THE PERIOD AUGUST 30 TO SEPTEMBER 13, 1951. ACCORDINGLY, THE EXCEPTION TAKEN TO THE LEAVE PAYMENT HAS ALSO BEEN REMOVED.

SINCE YOUR INDEBTEDNESS WAS REFERRED TO THE DEPARTMENT OF JUSTICE (YOUR CURRENT EMPLOYER) UNDER THE PROVISIONS OF THE ACT OF AUGUST 3, 1950, 64 STAT. 393--- WHICH AUTHORIZES THE WITHHOLDING OF COMPENSATION DUE GOVERNMENT PERSONNEL--- THAT DEPARTMENT IS BEING ADVISED THIS DATE THAT ON THE BASIS OF THE EVIDENCE NOW OF RECORD, YOUR INDEBTEDNESS IS BEING CANCELED.
