WAS AWAY FROM HIS OFFICIAL STATION FROM 12:04 P.M. HIS OUTGOING JOURNEY WAS MADE BY TRAIN FROM THE RAIL TERMINAL IN GULFPORT. WHEREAS HIS RETURN JOURNEY WAS BY GOVERNMENT AIRCRAFT WITH LANDING AT THE KEESLER AIR FORCE BASE LOCATED WITHIN THE CORPORATE LIMITS OF BILOXI. TECHNICAL TRAINING AIR FORCE IS NOT LOCATED WITHIN THE CORPORATE LIMITS OF GULFPORT BUT IS APPROXIMATELY TWO (2) MILES EAST OF THE CITY LIMITS. THE TRAIN ON WHICH HE TRAVELED DID NOT DEPART THEREFROM UNTIL 12:04 P.M.THE SUSPENSION WAS PREDICATED UPON THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS. OF WHICH PROVIDES AS FOLLOWS: "THE TIME OF ARRIVAL AT AND DEPARTURE FROM A PLACE WILL BE CONSIDERED AS THE HOUR AT WHICH THE TRAIN.

ON APRIL 4, 1957, THE DIRECTOR OF ACCOUNTING AND FINANCE, HEADQUARTERS UNITED STATES AIR FORCE, TRANSMITTED HERE FOR CONSIDERATION YOUR LETTER OF FEBRUARY 14, 1957, REQUESTING OUR DECISION WHETHER YOU MAY CERTIFY FOR PAYMENT THE RECLAIM VOUCHER FOR $2.25 TRANSMITTED THEREWITH STATED IN FAVOR OF JACK L. CALHOUN, A CIVILIAN EMPLOYEE ASSIGNED TO HEADQUARTERS, TECHNICAL TRAINING AIR FORCE, GULFPORT, MISSISSIPPI.

THE RECORD DISCLOSES THAT MR. CALHOUN, A RESIDENT OF GULFPORT, WAS AWAY FROM HIS OFFICIAL STATION FROM 12:04 P.M., MAY 6, UNTIL AFTER 6 P.M., MAY 11, 1956, PURSUANT TO ORDERS WHICH DIRECTED HIM TO PERFORM SEVERAL DAYS TEMPORARY DUTY AT SCOTT AIR FORCE BASE, ILLINOIS. HIS OUTGOING JOURNEY WAS MADE BY TRAIN FROM THE RAIL TERMINAL IN GULFPORT, WHEREAS HIS RETURN JOURNEY WAS BY GOVERNMENT AIRCRAFT WITH LANDING AT THE KEESLER AIR FORCE BASE LOCATED WITHIN THE CORPORATE LIMITS OF BILOXI, MISSISSIPPI, APPROXIMATELY SEVEN MILES EAST OF GULFPORT AND FIVE MILES EAST OF HIS OFFICIAL DUTY STATION. YOU POINT OUT THAT HEADQUARTERS, TECHNICAL TRAINING AIR FORCE IS NOT LOCATED WITHIN THE CORPORATE LIMITS OF GULFPORT BUT IS APPROXIMATELY TWO (2) MILES EAST OF THE CITY LIMITS.

THE AMOUNT RECLAIMED REPRESENTS PER DIEM FOR ONE-FOURTH DAY ADMINISTRATIVELY SUSPENDED ON VOUCHER NO. 16418 OF YOUR MAY 1956 ACCOUNTS, FOR THE REASON THAT ALTHOUGH THE CLAIMANT LEFT HIS RESIDENCE AT 10:45 A.M., AND ARRIVED AT THE GULFPORT RAILWAY TERMINAL AT 11 A.M., MAY 6, THE TRAIN ON WHICH HE TRAVELED DID NOT DEPART THEREFROM UNTIL 12:04 P.M.THE SUSPENSION WAS PREDICATED UPON THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS, AS AMENDED PARAGRAPH 48B (NOW SECTION 6.9.C.) OF WHICH PROVIDES AS FOLLOWS:

"THE TIME OF ARRIVAL AT AND DEPARTURE FROM A PLACE WILL BE CONSIDERED AS THE HOUR AT WHICH THE TRAIN, BOAT, OR OTHER CONVEYANCE USED BY THE TRAVELER ACTUALLY LEAVES OR ARRIVES AT ITS REGULAR TERMINAL.'

OUR VIEW IS THAT FOR PER DIEM PURPOSES THE TIME OF DEPARTURE ON TEMPORARY DUTY IS REQUIRED BY THE REGULATIONS, ABOVE, TO BE CONSIDERED AS THE ACTUAL TIME OF DEPARTURE OF THE TRAIN FROM GULFPORT. CONCERNING 24 COMP. GEN. 763, REFERRED TO IN YOUR LETTER, IT SUFFICES TO SAY THAT THAT DECISION RELATES TO TAXICAB FARES OF MILITARY PERSONNEL AND NOT TO PER DIEM OF CIVILIAN EMPLOYEES. ACCORDINGLY, PAYMENT ON THE SUBMITTED VOUCHER IS NOT AUTHORIZED, AND SUCH VOUCHER, WITH RELATED PAPERS, WILL BE RETAINED HERE.

YOU REQUEST OUR VIEW AS TO WHETHER KEESLER AIR FORCE BASE WOULD OR WOULD NOT BE REGARDED AS THE "REGULAR TERMINAL" UNDER SECTION 6.9.C OF THE TRAVEL REGULATIONS FOR CIVILIAN EMPLOYEES STATIONED AT HEADQUARTERS, TECHNICAL TRAINING AIR FORCE. YOU ARE INFORMED THAT KEESLER AIR FORCE BASE IS CONSIDERED BY US TO BE THE REGULAR TERMINAL FOR THE EMPLOYEES HERE INVOLVED AND PER DIEM IS TO BE COMPUTED FROM TIME OF ACTUAL DEPARTURE OR ARRIVAL AT THAT POINT BY GOVERNMENT AIRPLANE.
