TO HONORABLE RAYMOND BLATTENBERGER: REFERENCE IS MADE TO YOUR LETTER OF MARCH 6. YOU STATE THAT WHEN THE BIDS WERE EXAMINED BY THE CONTRACTING OFFICER HE NOTED THAT THE BID OF MCGREGOR AND WERNER. WAS PROBABLY IN ERROR BECAUSE IT WAS OUT OF LINE WITH THE OTHER SIX BIDS RECEIVED. THAT THE CORPORATION WAS REQUESTED BY THE TELEPHONE TO REVIEW THE SPECIFICATIONS AND CONFIRM ITS BID PRICE. ADVISED THAT ITS BID WAS IN ERROR IN THAT THE PRICE OF $121.69 WAS INTENDED AS THE PRICE FOR ONE THOUSAND SETS AND NOT AS THE PRICE FOR THE ENTIRE QUANTITY OF FORMS. WAS QUOTED A PRICE OF $121.69 PER THOUSAND LESS A DISCOUNT OF 20 PERCENT FOR THE FORMS. THERE IS NO ROOM FOR DOUBT THAT THE CORPORATION MADE AND ERROR IN ITS BID.

REFERENCE IS MADE TO YOUR LETTER OF MARCH 6, 1957, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING AN ERROR WHICH MCGREGOR AND WERNER, INC., ALLEGES IT MADE IN ITS BID OPENED ON FEBRUARY 26, 1957.

THE GOVERNMENT PRINTING OFFICE REQUESTED BIDS UNDER JACKET NO. 416646, FOR THE PRODUCTION OF 5,000 SETS OF A 11-PART SINGLE STUB CARBON INTERLEAVED FORM. IN RESPONSE MCGREGOR AND WERNER, C., SUBMITTED A BID DATED FEBRUARY 26, 1957, OFFERING TO FURNISH THE FORMS FOR A LOT PRICE OF $121.69.

YOU STATE THAT WHEN THE BIDS WERE EXAMINED BY THE CONTRACTING OFFICER HE NOTED THAT THE BID OF MCGREGOR AND WERNER, INC., WAS PROBABLY IN ERROR BECAUSE IT WAS OUT OF LINE WITH THE OTHER SIX BIDS RECEIVED, RANGING FROM $394 TO $658.75, AND WITH THE PRICE PREVIOUSLY PAID, $336, FOR THE SAME QUANTITY OF 11-PART FORMS; AND THAT THE CORPORATION WAS REQUESTED BY THE TELEPHONE TO REVIEW THE SPECIFICATIONS AND CONFIRM ITS BID PRICE.

BY LETTER DATED FEBRUARY 26, 1957, MCGREGOR AND WERNER, INC., ADVISED THAT ITS BID WAS IN ERROR IN THAT THE PRICE OF $121.69 WAS INTENDED AS THE PRICE FOR ONE THOUSAND SETS AND NOT AS THE PRICE FOR THE ENTIRE QUANTITY OF FORMS. THE CORPORATION REQUESTED THAT IT BE PERMITTED TO WITHDRAW ITS BID ON THE FORMS. IN SUPPORT OF ITS ALLEGATION OF ERROR, THE CORPORATION SUBMITTED A QUOTATION DATED FEBRUARY 18, 1957, RECEIVED FROM ITS SUPPLIER, SOUTHERN PAPER INDUSTRIES, INC., GASTONIA, NORTH CAROLINA, IN WHICH MCGREGOR AND WERNER, INC., WAS QUOTED A PRICE OF $121.69 PER THOUSAND LESS A DISCOUNT OF 20 PERCENT FOR THE FORMS.

ON THE RECORD, THERE IS NO ROOM FOR DOUBT THAT THE CORPORATION MADE AND ERROR IN ITS BID, AS ALLEGED. ACCORDINGLY, SINCE IT WAS BELIEVED THAT THE BID OF THE MCGREGOR AND WERNER, INC., WAS ERRONEOUS, AND SUCH BELIEF WAS CONFIRMED AND THE ERROR EXPLAINED BY THE BIDDER PRIOR TO AWARD, THE BID OF THE CORPORATION MAY BE DISREGARDED IN ASKING THE AWARD.

THE PAPERS, WITH THE EXCEPTION OF THE CORPORATIONS' LETTER OF FEBRUARY 26, 1957, AND THE COPY OF THE QUOTATION RECEIVED FROM ITS SUPPLIER, ARE RETURNED.
