PAYMENT IS AUTHORIZED ON THE ENCLOSED VOUCHER IN FAVOR OF RALPH S. THAT AFTER DELIVERING THE EMPLOYEE TO THE AIRPORT THE AUTOMOBILE WAS RETURNED TO HIS RESIDENCE. THE AUTOMOBILE WAS THEREBY DRIVEN A TOTAL OF 34 MILES FOR THE ROUND-TRIP TRAVEL BETWEEN RESIDENCE AND AIRPORT. THE AUTOMOBILE WAS DRIVEN THE SAME ROUND-TRIP DISTANCE TO PICK UP THE EMPLOYEE AT THE AIRPORT. AT THE RATE OF 5-CENTS A MILE FOR USE OF PRIVATELY OWNED MOTORCYCLES OR 8-CENTS A MILE FOR USE OF PRIVATELY OWNED AUTOMOBILES OR AIRPLANES WILL BE PAID FOR TEMPORARY DUTY TRAVEL BY PRIVATE CONVEYANCE AUTHORIZED OR APPROVED AS MORE ADVANTAGEOUS TO THE GOVERNMENT. "MILEAGE AND PARKING FEES MAY BE PAID FROM AN EMPLOYEE'S RESIDENCE TO A TERMINAL SO LONG AS THE AMOUNT CLAIMED DOES NOT EXCEED THE USUAL ALLOWABLE TAXICAB FARES. * * *" THE ORIGINAL TRAVEL VOUCHER WAS APPROVED FOR PAYMENT ON THE BASIS OF THE ABOVE-QUOTED REGULATIONS.

YOUR LETTER OF JANUARY 4, 1957 (FILE SWFCF), TRANSMITTED HERE BY LETTER DATED JANUARY 17, 1957 (FILE ENGCR), FROM THE OFFICE OF THE CHIEF OF ENGINEERS, REQUESTS OUR DECISION WHETHER, UNDER THE FACTS AND CIRCUMSTANCES RELATED BELOW, PAYMENT IS AUTHORIZED ON THE ENCLOSED VOUCHER IN FAVOR OF RALPH S. MAY, AN EMPLOYEE OF THE CORPS OF ENGINEERS.

THE RECORD SHOWS THAT ON NOVEMBER 14, 1956, THE EMPLOYEE USED A PRIVATELY OWNED AUTOMOBILE FROM RESIDENCE TO AIRPORT, A DISTANCE OF 17 MILES, AND THAT AFTER DELIVERING THE EMPLOYEE TO THE AIRPORT THE AUTOMOBILE WAS RETURNED TO HIS RESIDENCE. THE AUTOMOBILE WAS THEREBY DRIVEN A TOTAL OF 34 MILES FOR THE ROUND-TRIP TRAVEL BETWEEN RESIDENCE AND AIRPORT. UPON THE EMPLOYEE'S RETURN ON NOVEMBER 17, 1956, THE AUTOMOBILE WAS DRIVEN THE SAME ROUND-TRIP DISTANCE TO PICK UP THE EMPLOYEE AT THE AIRPORT. THE RECORD SHOWS THE USUAL TAXICAB FARE FOR THE DISTANCE FROM RESIDENCE TO AIRPORT AS APPROXIMATELY $4. THE VOUCHER IN THE AMOUNT OF $4.08 REPRESENTS THE DIFFERENCE BETWEEN THE MILEAGE CLAIMED (68 MILES AT 10 CENTS PER MILE OR $6.80) AND THE MILEAGE PAID (34 MILES AT 8 CENTS PER MILE OR $2.72) ON D.O. VOU. NO. 586 IN YOUR NOVEMBER 1956 ACCOUNT, SYMBOL 5509.

CIVILIAN PERSONNEL REGULATIONS (REVISED JUNE 28, 1956), DEPARTMENT OF THE ARMY, PROVIDE RATES OF REIMBURSEMENT FOR TRAVEL BY PRIVATE CONVEYANCE AS FOLLOWS:

CPR T3.3-4A (1) (A). "MILEAGE, AT THE RATE OF 5-CENTS A MILE FOR USE OF PRIVATELY OWNED MOTORCYCLES OR 8-CENTS A MILE FOR USE OF PRIVATELY OWNED AUTOMOBILES OR AIRPLANES WILL BE PAID FOR TEMPORARY DUTY TRAVEL BY PRIVATE CONVEYANCE AUTHORIZED OR APPROVED AS MORE ADVANTAGEOUS TO THE GOVERNMENT. IN SUCH CASES, THE MILEAGE RATE AS AUTHORIZED OR APPROVED MAY BE PAID FROM WHATEVER POINT THE EMPLOYEE BEGINS THE JOURNEY.'

CPR T3.8-5C (5). "MILEAGE AND PARKING FEES MAY BE PAID FROM AN EMPLOYEE'S RESIDENCE TO A TERMINAL SO LONG AS THE AMOUNT CLAIMED DOES NOT EXCEED THE USUAL ALLOWABLE TAXICAB FARES. * * *"

THE ORIGINAL TRAVEL VOUCHER WAS APPROVED FOR PAYMENT ON THE BASIS OF THE ABOVE-QUOTED REGULATIONS. THE FOLLOWING AMENDMENT, HOWEVER, WAS ISSUED TO THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS EFFECTIVE AUGUST 1, 1956.

SECTION 3.5B (1), LAST PARAGRAPH. "IN LIEU OF THE USE OF A TAXICAB UNDER THE PROVISIONS OF SECTION 3.1B, PAYMENT ON A MILEAGE BASIS AT THE RATE OF 10 CENTS PER MILE WILL BE ALLOWED FOR THE ROUND-TRIP MILEAGE OF A PRIVATELY OWNED AUTOMOBILE USED IN CONNECTION WITH AN EMPLOYEE GOING FROM HIS PLACE OF ABODE TO A COMMON CARRIER TERMINAL OR FROM A COMMON CARRIER TERMINAL TO HIS PLACE OF ABODE: PROVIDED, THAT THE AMOUNT OF REIMBURSEMENT SHALL NOT EXCEED THE USUAL TAXICAB FARE, INCLUDING ALLOWABLE TIP, FOR A ONE-WAY TRIP FROM HIS PLACE OF ABODE TO TERMINAL OR FROM TERMINAL TO HIS PLACE OF ABODE.'

THE ABOVE-QUOTED SECTION 3.5B (1) CLEARLY AUTHORIZES PAYMENT FOR ROUND- TRIP MILEAGE FOR USE OF PRIVATELY OWNED AUTOMOBILE IN TRANSPORTING AN EMPLOYEE FROM HIS PLACE OF ABODE TO A COMMON CARRIER TERMINAL AND FROM A COMMON CARRIER TERMINAL TO HIS PLACE OF ABODE AT A RATE OF 10 CENTS PER MILE, PROVIDED THE AMOUNT DOES NOT EXCEED THE USUAL ONE-WAY TAXICAB FARE, INCLUDING ALLOWABLE TIP, BETWEEN SUCH POINTS.

ACCORDINGLY, THE VOUCHER WHICH, TOGETHER WITH RELATED PAPERS, IS RETURNED HEREWITH, MAY BE PAID, IF OTHERWISE CORRECT.
