IT APPEARS THAT A NEW SCHEDULE OF INCREASED RATES FOR THE GROUP IN WHICH THESE THREE EMPLOYEES WERE INCLUDED BECAME EFFECTIVE JANUARY 23. THAT THE TITLES OF THE POSITIONS OCCUPIED BY THESE THREE EMPLOYEES WERE CHANGED TO LOWER DESIGNATIONS ALTHOUGH THE APPLICABLE WAGE RATES FOR THE LOWER DESIGNATED POSITIONS WERE INCREASED OVER THE RATES PREVIOUSLY PAID IN THEIR HIGHER DESIGNATIONS. THE THREE EMPLOYEES WERE GRANTED 30 DAYS IN WHICH TO APPEAL. IN THE REVIEW THE PROPOSED LOWERING OF THEIR DESIGNATIONS WAS UPHELD AND THEY WERE PAID THE INCREASED RATES FOR THE LOWER DESIGNATIONS. AS THESE EMPLOYEES WOULD HAVE BEEN ENTITLED TO AT LEAST THE INCREASES APPLICABLE TO THE LOWER DESIGNATIONS REGARDLESS OF THE OUTCOME OF ANY APPEAL.

YOUR LETTER OF DECEMBER 19, 1956, REQUESTS OUR DECISION WHETHER YOU MAY CERTIFY FOR PAYMENT THE PAYROLL VOUCHER FORWARDED THEREWITH. THE VOUCHER PROPOSES PAYMENT TO THREE WAGE BOARD EMPLOYEES FOR THE DIFFERENCE BETWEEN THEIR WAGE RATE IN EFFECT PRIOR TO JANUARY 23, 1956, AND THE INCREASES APPLICABLE TO THEIR RESPECTIVE POSITIONS AFTER THAT DATE AND UP TO APRIL 9 AS TO TWO OF THE EMPLOYEES, AND UP TO MAY 7, 1956, AS TO THE THIRD, ON WHICH LATTER DATES THEY RECEIVED THE INCREASED RATES.

IT APPEARS THAT A NEW SCHEDULE OF INCREASED RATES FOR THE GROUP IN WHICH THESE THREE EMPLOYEES WERE INCLUDED BECAME EFFECTIVE JANUARY 23, 1956, BUT THAT THE TITLES OF THE POSITIONS OCCUPIED BY THESE THREE EMPLOYEES WERE CHANGED TO LOWER DESIGNATIONS ALTHOUGH THE APPLICABLE WAGE RATES FOR THE LOWER DESIGNATED POSITIONS WERE INCREASED OVER THE RATES PREVIOUSLY PAID IN THEIR HIGHER DESIGNATIONS. THE THREE EMPLOYEES WERE GRANTED 30 DAYS IN WHICH TO APPEAL. ONLY ONE FILED AN APPEAL BUT IN CONNECTION WITH THAT APPEAL THE PHA DECIDED TO REVIEW THE POSITION TITLES OF ALL THREE EMPLOYEES. IN THE REVIEW THE PROPOSED LOWERING OF THEIR DESIGNATIONS WAS UPHELD AND THEY WERE PAID THE INCREASED RATES FOR THE LOWER DESIGNATIONS, TWO FROM APRIL 9, 1956, AND ONE FROM MAY 7, 1956.

AS THESE EMPLOYEES WOULD HAVE BEEN ENTITLED TO AT LEAST THE INCREASES APPLICABLE TO THE LOWER DESIGNATIONS REGARDLESS OF THE OUTCOME OF ANY APPEAL, IT WOULD HAVE BEEN PROPER TO HAVE PAID THEM AT THE INCREASED RATES APPLICABLE TO THE LOWER DESIGNATIONS FROM THE DATE OF THE GENERAL SCHEDULE INCREASE, JANUARY 23, 1956. CF. 34 COMP. GEN. 563. ACCORDINGLY, THE VOUCHER PREPARED TO ACCOMPLISH THAT PURPOSE MAY NOW BE CERTIFIED FOR PAYMENT IF OTHERWISE CORRECT.
