PUBLIC PRINTER: REFERENCE IS MADE TO YOUR LETTER OF DECEMBER 18. YOU STATE THAT WHEN THE BIDS WERE EXAMINED BY THE CONTRACTING OFFICER HE NOTED THAT THE BID OF THE EASTERN LITHOGRAPHING CORPORATION WAS POSSIBLY IN ERROR BECAUSE IT WAS OUT OF LINE WITH THE EIGHT OTHER BIDS RECEIVED. THE CORPORATION WAS REQUESTED TO REVIEW THE SPECIFICATIONS AND CONFIRM ITS BID PRICE. THE CORPORATION ADVISED THAT AN ERROR HAD BEEN MADE IN ITS BID AND THAT ITS BID PRICE FOR THE JOB SHOULD HAVE BEEN $1. WITH THE LETTER THE CORPORATION SUBMITTED ITS ORIGINAL ESTIMATE SHEET WHICH SHOWS THAT IN THE $870 BID SUBMITTED THERE WAS INCLUDED ONLY $200 FOR PRESSWORK. FOR WHICH THE BIDDER STATED THE CORRECT AMOUNT SHOULD HAVE BEEN $550.

REFERENCE IS MADE TO YOUR LETTER OF DECEMBER 18, 1956, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING AN ERROR WHICH THE EASTERN LITHOGRAPHING CORPORATION, PHILADELPHIA, PENNSYLVANIA, ALLEGES IT MADE IN ITS BID OPENED ON DECEMBER 10, 1956.

THE GOVERNMENT PRINTING OFFICE REQUESTED BIDS UNDER JACKET NO. 407787, FOR THE PRINTING, BINDING AND PACKING OF 115,005 COPIES OF A PAMPHLET CONTAINING 16 PAGES HAVING A TRIM SIZE OF 8 1/2 INCHES BY 11 INCHES, FOR SHIPMENT ON OR BEFORE JANUARY 11, 1957. IN RESPONSE THE EASTERN LITHOGRAPHING CORPORATION SUBMITTED A BID DATED DECEMBER 7, 1956, OFFERING TO PERFORM THE JOB FOR THE LUMP SUM OF $870.

YOU STATE THAT WHEN THE BIDS WERE EXAMINED BY THE CONTRACTING OFFICER HE NOTED THAT THE BID OF THE EASTERN LITHOGRAPHING CORPORATION WAS POSSIBLY IN ERROR BECAUSE IT WAS OUT OF LINE WITH THE EIGHT OTHER BIDS RECEIVED, RANGING FROM $1,050 TO $1,588, AND WITH THE GOVERNMENT PRINTING OFFICE ESTIMATE OF $1,214.14; AND THAT ON DECEMBER 11, 1956, THE CORPORATION WAS REQUESTED TO REVIEW THE SPECIFICATIONS AND CONFIRM ITS BID PRICE.

BY LETTER DATED DECEMBER 12, 1956, THE CORPORATION ADVISED THAT AN ERROR HAD BEEN MADE IN ITS BID AND THAT ITS BID PRICE FOR THE JOB SHOULD HAVE BEEN $1,145 INSTEAD OF $870. WITH THE LETTER THE CORPORATION SUBMITTED ITS ORIGINAL ESTIMATE SHEET WHICH SHOWS THAT IN THE $870 BID SUBMITTED THERE WAS INCLUDED ONLY $200 FOR PRESSWORK, FOR WHICH THE BIDDER STATED THE CORRECT AMOUNT SHOULD HAVE BEEN $550. YOU STATE THAT THE CONTRACTING OFFICER IS OF THE OPINION THAT $550 IS A FAIR AND REASONABLE PRICE FOR THE PRESSWORK.

ON THE RECORD, THERE IS NO ROOM FOR REASONABLE DOUBT THAT THE CORPORATION MADE AN ERROR IN ITS BID, AS ALLEGED. ACCORDINGLY, SINCE IT WAS BELIEVED THAT THE BID OF THE EASTERN LITHOGRAPHING CORPORATION WAS ERRONEOUS, AND SINCE SUCH BELIEF WAS CONFIRMED AND THE ERROR WAS EXPLAINED BY THE BIDDER PRIOR TO AWARD, THE BID OF THE CORPORATION MAY BE DISREGARDED IN MAKING THE AWARD.

THE PAPERS WITH THE EXCEPTION OF THE CORPORATION'S LETTER OF DECEMBER 12, 1956, AND ITS ESTIMATE SHEET ARE RETURNED.
