REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 19, 1956, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING AN ERROR PUBLICATION PRESS, INC., BALTIMORE, MARYLAND, ALLEGES IT MADE IN ITS BID ON WHICH UNNUMBERED CONTRACT (PURCHASE ORDER NO. 5807) DATED OCTOBER 9, 1956, IS BASED. RECEIPT IS ALSO ACKNOWLEDGED OF THE ACTING PUBLIC PRINTER'S LETTER OF OCTOBER 26, 1956.

THE GOVERNMENT PRINTING OFFICE REQUESTED BIDS UNDER JACKET NO. 399178 FOR THE PRODUCTION OF 5,000 COPIES OF A BOOK CONTAINING 112 PAGES AND COVER, TRIM SIZE 5 7/8 INCHES BY 9 1/8 INCHES. THE SPECIFICATIONS PROVIDE THAT THE CONTRACTOR SHALL APPLY A COATING OVER THE ENTIRE SURFACE OF THE FACE AND BACK OF THE COVER OF THE BOOK, EXCEPT FOR AN APPROXIMATE 3/8 INCH STRIP ALONG THE BINDING EDGE AND THAT SUCH COATING IS TO BE OR CLEAR TRANSPARENT PLASTIC OR SIMILAR WHICH WILL GIVE A SMOOTH EVEN COATING AND WHICH WILL NOT CURL OR FLAKE AT THE EDGES OR BREAK WHEN BENT. IN RESPONSE PUBLICATION PRESS, INC., SUBMITTED A BID DATED OCTOBER 4, 1956, OFFERING TO FURNISH THE BOOKS FOR THE LUMP SUM OF $825, WHICH WAS ACCEPTED ON OCTOBER 9, 1956.

YOU STATE THAT ON OCTOBER 12, 1956, A REPRESENTATIVE OF PUBLICATION PRESS, INC., TELEPHONED ALLEGING THAT THE CORPORATION HAD MADE AN ERROR IN ITS BID IN THAT IT HAD FAILED TO INCLUDE IN ITS BID PRICE THE COST OF THE COVER COATING AND THAT ITS ESTIMATOR, WHEN READING THE SPECIFICATIONS, DID NOT NOTE THE ADDITIONAL SPECIFICATIONS, WHICH WERE ON THE REVERSE SIDE OF THE SPECIFICATION SHEET.

IN A CONFIRMING LETTER DATED OCTOBER 15, 1956, THE CORPORATION STATED THAT SINCE NOTING ITS ERROR IT HAD CONTACTED SEVERAL COMPANIES FOR A QUOTATION ON THE WORK OF LAMINATING THE COVERS AND THAT IT HAD FINALLY RECEIVED A TENTATIVE QUOTATION FROM THE MORGAN LAMINATING AND FOLIATING COMPANY OF NEW YORK CITY IN THE AMOUNT OF $1000 FOR LAMINATING IN ACCORDANCE WITH THE SPECIFICATIONS. IN SUPPORT OF ITS ALLEGATION OF ERROR, THE CORPORATION SUBMITTED ITS ORIGINAL JOB ESTIMATE SHEET WHICH SHOWS THAT THE COST OF LAMINATING THE COVERS WAS NOT INCLUDED IN ITS ESTIMATE.

IT IS REPORTED THAT THE ONLY OTHER BIDDER ON THE BOOKS SPECIFIED A LUMP SUM PRICE OF $1,139; THAT THE TOTAL GOVERNMENT PRINTING OFFICE ESTIMATE FOR THE ENTIRE JOB IS $1,481.11; AND THAT THE GOVERNMENT PRINTING OFFICE'S ESTIMATE FOR LAMINATING THE COVERS IS $580. IN THE ACTING PUBLIC PRINTER'S LETTER OF OCTOBER 26, 1956, IT IS STATED THAT THE CONTRACTING OFFICER HAS ADVISED THAT AT THE TIME HE EVALUATED THE BIDS, HE DID NOT REALIZE THAT THE PRODUCTION OF THE BOOKS INVOLVED AN OPERATION OF COATING THE SURFACE OF THE COVERS, AND THAT HAD HE BEEN AWARE OF THIS AND THE FACT THAT THIS OPERATION ALONE IS ESTIMATED TO COST $580, HE WOULD HAVE SUSPECTED AN ERROR IN THE BID FROM PUBLICATION PRESS, INC., AND WOULD HAVE QUESTIONED THE BID PRICE OF THIS BIDDER BEFORE MAKING AWARD.

THE RECORD INDICATES THAT HAD THE CONTRACTING OFFICER PROPERLY APPRAISED THE SCOPE OF THE WORK INVOLVED IN THE PRODUCTION OF THE BOOKS IN THE LIGHT OF THE GOVERNMENT'S ESTIMATE, HE WOULD HAVE QUESTIONED THE PRICE QUOTED BY THE PUBLICATION PRESS, INC., IN ITS BID PRIOR TO ITS ACCEPTANCE. THE CONTRACT INVOLVED MAY ACCORDINGLY BE CANCELLED WITHOUT LIABILITY TO THE CORPORATION.

THE PAPERS, WITH THE EXCEPTION OF THE CORPORATION'S LETTER OF OCTOBER 15, 1956, AND ITS ESTIMATE SHEET, ARE RETURNED.
