DEPARTMENT OF THE ARMY: REFERENCE IS MADE TO YOUR COMMUNICATION DATED SEPTEMBER 10. THE EXPENSES WERE INCURRED BY MR. LANE'S NAME WAS ONE OF THE TWENTY-THREE SUBMITTED. A TELETYPE WAS THEN SUBMITTED TO THE SOUTHWESTERN DIVISION BY LMVD ADVISING THAT MR. LANE AND ONE OTHER EMPLOYEE IN THE SOUTHWESTERN DIVISION WERE BEING CONSIDERED AND REQUESTING THAT MR. LANE WAS DIRECTED TO PROCEED TO VICKSBURG. LANE WAS CONSIDERED NECESSARY BY LMVD TO DETERMINE CERTAIN PERSONAL CHARACTERISTICS WHICH COULD NOT BE ASCERTAINED BY REVIEWING THE EMPLOYEE'S APPLICATION OF STANDARD FORM NO. 57. THESE CHARACTERISTICS WERE ADMINISTRATIVELY MADE PART OF THE JOB REQUIREMENTS BASED ON THE FACT THAT WHILE THE CIVIL SERVICE COMMISSION ESTABLISHES THE MINIMUM QUALIFICATION REQUIREMENTS FOR THE VARIOUS GRADES.

REFERENCE IS MADE TO YOUR COMMUNICATION DATED SEPTEMBER 10, 1956 (FILE SWP CF), TRANSMITTED HERE THROUGH THE CHIEF OF ENGINEERS, REQUESTING OUR DECISION AS TO THE PROPRIETY OF PAYING AN ACCOMPANYING VOUCHER STATED IN FAVOR OF MR. JACK H. LANE, REALTY ASSISTANT SUPERVISOR GS-9, CORPS OF ENGINEERS, AN EMPLOYEE OF THE TULSA DISTRICT, IN REIMBURSEMENT OF TRAVEL EXPENSES.

THE EXPENSES WERE INCURRED BY MR. LANE ON A TRIP FROM TULSA, OKLAHOMA, TO VICKSBURG, MISSISSIPPI, AND RETURN, UNDERTAKEN FOR THE PURPOSE OF BEING INTERVIEWED BY THE OFFICE OF THE DIVISION ENGINEER, LOWER MISSISSIPPI VALLEY DIVISION, CORPS OF ENGINEERS, VICKSBURG, MISSISSIPPI, FOR A POSITION OF REALTY OFFICER GS-1172-11.

IT APPEARS THAT THE LOWER MISSISSIPPI VALLEY DIVISION REQUESTED ASSISTANCE FROM THE CHIEF OF ENGINEERS IN FILLING THE POSITION OF REALTY OFFICER GS-1172-11. THE CHIEF OF ENGINEERS, FURNISHED THE NAMES OF TWENTY -THREE PERSONS WHO APPEARED TO BE QUALIFIED TO FILL THE POSITION. MR. LANE'S NAME WAS ONE OF THE TWENTY-THREE SUBMITTED. LMVD NOTIFIED THE DIVISION ENGINEER, SOUTHWESTERN DIVISION, DALLAS, TEXAS, BY TELETYPE, ADVISING THEM OF THE VACANCY AND REQUESTING THAT INTERESTED EMPLOYEES SUBMIT APPLICATIONS. PURSUANT THERETO, MR. LANE SUBMITTED A STANDARD FORM NO. 57. A TELETYPE WAS THEN SUBMITTED TO THE SOUTHWESTERN DIVISION BY LMVD ADVISING THAT MR. LANE AND ONE OTHER EMPLOYEE IN THE SOUTHWESTERN DIVISION WERE BEING CONSIDERED AND REQUESTING THAT MR. LANE BE MADE AVAILABLE FOR ONE DAY TEMPORARY DUTY. PURSUANT THERETO BY ORDERS DATED MAY 25, 1956, MR. LANE WAS DIRECTED TO PROCEED TO VICKSBURG.

IT APPEARS THAT AN INTERVIEW WITH MR. LANE WAS CONSIDERED NECESSARY BY LMVD TO DETERMINE CERTAIN PERSONAL CHARACTERISTICS WHICH COULD NOT BE ASCERTAINED BY REVIEWING THE EMPLOYEE'S APPLICATION OF STANDARD FORM NO. 57. THESE CHARACTERISTICS WERE ADMINISTRATIVELY MADE PART OF THE JOB REQUIREMENTS BASED ON THE FACT THAT WHILE THE CIVIL SERVICE COMMISSION ESTABLISHES THE MINIMUM QUALIFICATION REQUIREMENTS FOR THE VARIOUS GRADES, THE OPERATING AGENCIES MAY ESTABLISH ADDITIONAL REQUIREMENTS WHEN CONSIDERED NECESSARY.

IN VIEW OF THE FACT THAT THE PURPOSE OF THE INTERVIEW AT VICKSBURG WAS TO DETERMINE WHETHER MR. LANE SATISFIED THE ADDITIONAL REQUIREMENTS FOR THE POSITION OF REALTY OFFICER GS-1172-11, ADMINISTRATIVELY IMPOSED, AND NOT TO DETERMINE WHETHER HE MET THE STANDARDS FOR THE POSITION ESTABLISHED BY THE CIVIL SERVICE COMMISSION AND BECAUSE OF THE ESTABLISHED NEED OF THE LMVD FOR A QUALIFIED PERSON TO FILL THE POSITION IN QUESTION, WE CONCLUDE THAT SUCH TRAVEL WAS IN THE INTERESTS OF THE GOVERNMENT AND NOT PRIMARILY FOR THE BENEFIT OF THE EMPLOYEE. 34 COMP. ACCORDINGLY, THE VOUCHER, WHICH IS RETURNED, MAY BE PAID, IF OTHERWISE CORRECT.
