WE DEDUCTED THE $179.80 NOW CLAIMED BY YOU SINCE OUR RECORDS AT THAT TIME INDICATED THAT THE ACID MOVED FOR MILITARY USE AND WAS. WE HAVE NOW DEVELOPED ADDITIONAL INFORMATION WHICH SHOWS THAT THE SUBJECT ACID ACTUALLY MOVED FOR CIVIL USE. YOUR BILLS WILL BE PROCESSED FOR PAYMENT ON THE BASIS OF THE FULL COMMERCIAL RATES.

REFERENCE IS MADE TO YOUR LETTER OF JULY 6, 1956, FILE N-13439-G-A, REQUESTING, IN EFFECT, REVIEW OF THE DISALLOWANCE OF YOUR CLAIMS ON SUPPLEMENTAL BILLS NOS. N-5-13439-A-G-7, N-5-15426-B-G-4, AND N-5 13440-B- G-R-10-73, FOR A TOTAL OF $179.80, REPRESENTING ADDITIONAL CHARGES ALLEGED TO BE DUE FOR THE TRANSPORTATION OF 11 SHIPMENTS OF SPENT SULFURIC ACID MOVING UNDER GOVERNMENT BILLS OF LADING FROM TALLACOOSA, ALABAMA, TO EAST POINT AND AMERICUS, GEORGIA, DURING 1942.

YOU CLAIMED AND WERE PAID FOR THE INVOLVED SERVICES ON THE BASIS OF THE FULL COMMERCIAL RATES. WE DEDUCTED THE $179.80 NOW CLAIMED BY YOU SINCE OUR RECORDS AT THAT TIME INDICATED THAT THE ACID MOVED FOR MILITARY USE AND WAS, THEREFORE, ENTITLED TO THE APPLICATION OF LAND GRANT RATES, PURSUANT TO SECTION 321 (A) OF THE TRANSPORTATION ACT OF 1940, 54 STAT. 898, 954 (49 U.S.C. 65). WE HAVE NOW DEVELOPED ADDITIONAL INFORMATION WHICH SHOWS THAT THE SUBJECT ACID ACTUALLY MOVED FOR CIVIL USE.

ACCORDINGLY, YOUR BILLS WILL BE PROCESSED FOR PAYMENT ON THE BASIS OF THE FULL COMMERCIAL RATES.
