YOU FURTHER STATE THAT THE USE OF COMMERCIAL AIR WAS CLEARED WITH THE MILITARY SEA TRANSPORTATION SERVICE REPRESENTATIVE AT TAIPEI. WITH REGARD TO THE DELAY IN YOUR BEING FURNISHED GOVERNMENT TRANSPORTATION AND THE USE BY YOU OF COMMERCIAL AIR IT IS ADMINISTRATIVELY REPORTED: "* * * TRANSPORTATION WAS BOOKED VIA MATS. THIS FLIGHT WAS CANCELLED AND MR. GERINGER WAS INFORMED THAT THE NEXT SCHEDULED FLIGHT WOULD BE 29 SEPTEMBER AND HE WAS GIVEN REASONABLE ASSURANCE OF TRANSPORTATION VIA THAT FLIGHT. TAIPEI THAT HE WAS IN A HURRY TO REACH YOKOHAMA SINCE HE WAS DUE TO GO ON LEAVE AND THAT HE ELECTED TO PAY HIS OWN WAY AND TRAVEL VIA COMMERCIAL AIRLINE. HE WAS TOLD SPECIFICALLY THAT GOVERNMENT TRANSPORTATION WAS AVAILABLE AND THAT COMMERCIAL AIR TRAVEL PERFORMED BY HIM WOULD BE AT HIS OWN EXPENSE AND THAT HE WOULD NOT BE REIMBURSED FOR SAME.

THERE HAS BEEN FURTHER CONSIDERED YOUR CLAIM, AS A MARINE EMPLOYEE OF THE MILITARY SEA TRANSPORTATION SERVICE, FOR REIMBURSEMENT OF THE TRANSPORTATION EXPENSE YOU INCURRED DURING SEPTEMBER 1955 IN TRAVELING FROM TAIPEI, FORMOSA, TO YOKOHAMA, JAPAN.

ON THE MORNING OF SEPTEMBER 27, 1955, YOU REPORTED TO THE MILITARY SEA TRANSPORTATION SERVICE REPRESENTATIVE, TAIPEI, FORMOSA, FOR TRANSPORTATION TO YOKOHAMA "VIA SURFACE AND/OR GOVAIR.' IT FURTHER PROVIDES: "SIX DOLS PER DIEM AUTH VIA GOVAIR TRANS.' YOU DEPARTED FOR YOKOHAMA IN THE AFTERNOON OF SEPTEMBER 28, 1955, BY COMMERCIAL AIR (CIVIL AIR TRANSPORT). FOR THE FARE EXPENDED FOR THAT TRAVEL YOU SEEK REIMBURSEMENT.

YOU EXPLAIN THE USE OF COMMERCIAL AIR AS DUE TO DELAY IN BEING FURNISHED GOVERNMENT TRANSPORTATION AND THE NECESSITY FOR YOUR IMMEDIATE DEPARTURE FROM FORMOSA BECAUSE OF ILLNESS. YOU FURTHER STATE THAT THE USE OF COMMERCIAL AIR WAS CLEARED WITH THE MILITARY SEA TRANSPORTATION SERVICE REPRESENTATIVE AT TAIPEI, FORMOSA.

WITH REGARD TO THE DELAY IN YOUR BEING FURNISHED GOVERNMENT TRANSPORTATION AND THE USE BY YOU OF COMMERCIAL AIR IT IS ADMINISTRATIVELY REPORTED:

"* * * TRANSPORTATION WAS BOOKED VIA MATS, ON A FLIGHT SCHEDULED FOR 27 SEPTEMBER 1955. THIS FLIGHT WAS CANCELLED AND MR. GERINGER NOTIFIED MSTS REPRESENTATIVE, TAIPEI THAT HE WAS IN A HURRY TO REACH YOKOHAMA SINCE HE WAS DUE TO GO ON LEAVE AND THAT HE ELECTED TO PAY HIS OWN WAY AND TRAVEL VIA COMMERCIAL AIRLINE. HE WAS TOLD SPECIFICALLY THAT GOVERNMENT TRANSPORTATION WAS AVAILABLE AND THAT COMMERCIAL AIR TRAVEL PERFORMED BY HIM WOULD BE AT HIS OWN EXPENSE AND THAT HE WOULD NOT BE REIMBURSED FOR SAME. MR. GERINGER GAVE EVERY INDICATION OF UNDERSTANDING THESE CONDITIONS AND ELECTED TO TRAVEL VIA CHINESE CIVIL AIR TRANSPORT AIRCRAFT WHICH DEPARTED TAIPEI ON 28 SEPTEMBER 1955.'

WHILE, IN VIEW OF YOUR THEN STATE OF HEALTH, THE DESIRABILITY FOR YOUR IMMEDIATE DEPARTURE FROM FORMOSA IS UNDERSTANDABLE, OUR OFFICE CANNOT FAVORABLY CONSIDER A CLAIM FOR TRAVEL EXCEPT AS SUCH TRAVEL IS ADMINISTRATIVELY AUTHORIZED. YOUR ORDERS RESTRICTED YOUR TRAVEL TO SERVICE TRANSPORTATION OR GOVERNMENT AIR AND IT DOES NOT APPEAR FROM THE ADMINISTRATIVE REPORT--- WHICH REPORT MUST OF NECESSITY BE CONSIDERED AS CONTROLLING--- THAT YOUR TRAVEL BY COMMERCIAL AIR WAS AUTHORIZED. CONSEQUENTLY, WE HAVE NO ALTERNATIVE, IN THE ABSENCE OF ADMINISTRATIVE AUTHORIZATION OR APPROVAL OF YOUR TRAVEL BY COMMERCIAL AIR, BUT TO DISALLOW YOUR CLAIM FOR THE TRANSPORTATION EXPENSE INCURRED. HOWEVER, WE DO VIEW AS PROPERLY PAYABLE THE PER DIEM ALLOWANCE FOR AIR TRAVEL AUTHORIZED IN YOUR ORDERS AND A SETTLEMENT FOR THE PROPER AMOUNT DUE FOR PER DIEM WILL ISSUE IN REGULAR COURSE.

EXCEPT FOR THE PAYMENT OF THE PER DIEM ALLOWANCE AS INDICATED ABOVE, THE PRIOR DISALLOWANCE OF YOUR CLAIM BY SETTLEMENT DATED MARCH 29, 1956, IS SUSTAINED.
