FOR TRANSPORTATION OF HOUSEHOLD EFFECTS IN YOUR PRIVATELY OWNED HOUSE TRAILER WHICH WAS TOWED BY A HIRED MOVER. THE RECORD SHOWS THAT THE EXPENSE WAS INCURRED INCIDENT TO YOUR CHANGE OF OFFICIAL DUTY STATION FROM COLUMBUS. YOUR CLAIM WAS DISALLOWED FOR THE REASON THAT OUR OFFICE HAS HELD THAT A HOUSE TRAILER IS NOT REGARDED AS HOUSEHOLD EFFECTS. THERE IS NOTHING IN THE RECORD TO SHOW THAT THE COST OF TRANSPORTING THE HOUSE TRAILER WAS INCREASED BY REASON OF THE HOUSEHOLD EFFECTS CARRIED THEREIN. YOUR REQUEST FOR REVIEW APPEARS TO BE PREDICATED UPON THE FACT THAT CERTAIN SIMILAR CLAIMS HAVE BEEN ALLOWED BY OUR CLAIMS DIVISION IN THE PAST. YOU ARE ADVISED THAT ANY PAYMENTS WHICH MAY INADVERTENTLY HAVE BEEN MADE BY THE CLAIMS DIVISION OF OUR OFFICE IN ANALOGOUS CASES AFFORD NO GROUNDS FOR ALLOWANCE IN YOUR CASE.

B-128100, JUL. 25, 1956

TO MR. NORMAN V. LAWRENCE:

YOUR RECENT LETTER REQUESTS RECONSIDERATION OF THAT PART OF OUR SETTLEMENT OF FEBRUARY 16, 1956, WHICH DISALLOWED YOUR CLAIM IN THE AMOUNT OF $37.24, FOR TRANSPORTATION OF HOUSEHOLD EFFECTS IN YOUR PRIVATELY OWNED HOUSE TRAILER WHICH WAS TOWED BY A HIRED MOVER.

THE RECORD SHOWS THAT THE EXPENSE WAS INCURRED INCIDENT TO YOUR CHANGE OF OFFICIAL DUTY STATION FROM COLUMBUS, INDIANA, TO INDIANAPOLIS, INDIANA, UNDER AUTHORIZATION NO. 93-486, DATED MAY 23, 1955, AS AN EMPLOYEE OF THE DEPARTMENT OF AGRICULTURE.

YOUR CLAIM WAS DISALLOWED FOR THE REASON THAT OUR OFFICE HAS HELD THAT A HOUSE TRAILER IS NOT REGARDED AS HOUSEHOLD EFFECTS, AND THERE IS NOTHING IN THE RECORD TO SHOW THAT THE COST OF TRANSPORTING THE HOUSE TRAILER WAS INCREASED BY REASON OF THE HOUSEHOLD EFFECTS CARRIED THEREIN. SEE 32 COMP. GEN. 367; ID 451.

YOUR REQUEST FOR REVIEW APPEARS TO BE PREDICATED UPON THE FACT THAT CERTAIN SIMILAR CLAIMS HAVE BEEN ALLOWED BY OUR CLAIMS DIVISION IN THE PAST. IN THAT REGARD, YOU ARE ADVISED THAT ANY PAYMENTS WHICH MAY INADVERTENTLY HAVE BEEN MADE BY THE CLAIMS DIVISION OF OUR OFFICE IN ANALOGOUS CASES AFFORD NO GROUNDS FOR ALLOWANCE IN YOUR CASE. ACCORDINGLY, AND IN VIEW OF THE DECISIONS CITED ABOVE, THE SETTLEMENT OF FEBRUARY 16, 1956, DISALLOWING YOUR CLAIM WAS PROPER AND MUST BE SUSTAINED.
