IT APPEARS THAT THE CHILD (RICHARD MICHAEL FRIES) WAS BORN ON MAY 3. THAT HIS MOTHER AND FATHER WERE DIVORCED IN 1949. THAT HIS MOTHER AND THE CLAIMING OFFICER WERE MARRIED IN JULY 1953. THE OFFICER RELATES THAT THE CHILD'S FATHER WAS ORDERED BY THE COURT TO PAY $75 A MONTH FOR THE CHILD'S SUPPORT. THAT HE MAINTAINS THE CHILD AT HIS OWN EXPENSE FOR WHICH HE IS NOT REIMBURSED IN ANY MANNER. BY FIRST ENDORSEMENT DATED MAY 29, 1956, THE COMMANDANT OF THE MARINE CORPS FORWARDED YOUR LETTER OF MAY 23, 1956, WITH ENCLOSURES, FOR DECISION AS TO THE LEGALITY OF PAYING MAJOR KENNETH L. MOOS, 020949, U.S. MARINE CORPS, TRAVEL ALLOWANCE FOR A STEPCHILD ON PERMANENT CHANGE OF STATION.

IT APPEARS THAT THE CHILD (RICHARD MICHAEL FRIES) WAS BORN ON MAY 3, 1947; THAT HIS MOTHER AND FATHER WERE DIVORCED IN 1949; AND THAT HIS MOTHER AND THE CLAIMING OFFICER WERE MARRIED IN JULY 1953. IN A SUPPLEMENTAL STATEMENT DATED MAY 21, 1956, THE OFFICER RELATES THAT THE CHILD'S FATHER WAS ORDERED BY THE COURT TO PAY $75 A MONTH FOR THE CHILD'S SUPPORT; THAT THE FATHER CONTRIBUTED $30 A MONTH UNTIL ABOUT JULY 1954; AND HAS CONTRIBUTED NOTHING TO THE CHILD'S SUPPORT SINCE THAT TIME. THE OFFICER ALSO CERTIFIES THAT THE CHILD HAS NO OTHER INCOME, AND THAT HE MAINTAINS THE CHILD AT HIS OWN EXPENSE FOR WHICH HE IS NOT REIMBURSED IN ANY MANNER.

ON THE EVIDENCE SUBMITTED, THE OFFICER WILL BE CONSIDERED TO HAVE A DEPENDENT (UNMARRIED MINOR STEPCHILD) WITHIN THE MEANING OF SECTION 102/G) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 804, FOR THE PURPOSES OF SECTION 303/C) OF THAT ACT, SO LONG AS THERE IS NO MATERIAL CHANGE IN THE DEPENDENCY STATUS OF THE SAID CHILD.
