PUBLIC PRINTER: REFERENCE IS MADE TO YOUR LETTER OF MAY 25. TWO OTHER BIDS RECEIVED FOR THE JOB WERE $3. YOU STATE THAT THE CONTRACTING OFFICER TOOK NOTICE OF THE PROBABILITY THAT THE CORPORATION HAD MADE AN ERROR IN ITS LOW BID SINCE IT WAS OUT OF LINE WITH THE OTHER TWO BIDS. THAT IT HAD MADE A MATHEMATICAL ERROR OF $200 IN COMPUTING ITS BID AND THAT EXCEPT FOR THE ERROR ITS BID WOULD HAVE BEEN $2. FORWARDED ITS ORIGINAL WORKSHEET IN WHICH THE BID WAS COMPUTED WHICH CLEARLY ESTABLISHES THAT. AN ERROR OF $200 WAS MADE IN ADDING THE VARIOUS ITEMS OF ESTIMATED COSTS INVOLVED AND THAT ITS INTENDED BID ACTUALLY WAS $2. SINCE IT WAS BELIEVED THAT THE BID WAS ERRONEOUS AND SINCE SUCH BELIEF WAS CONFIRMED AND THE ALLEGED ERROR AND INTENDED BID PRICE WERE SATISFACTORILY ESTABLISHED PRIOR TO AWARD.

REFERENCE IS MADE TO YOUR LETTER OF MAY 25, 1956, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN WITH RESPECT TO A BID DATED MAY 10, 1956, SUBMITTED BY MONTAUK LITHOGRAPHERS, INC., IN VIEW OF THE BIDDER'S ALLEGATION OF ERROR.

IN ITS BID THE CORPORATION OFFERED THE SERVICES AND CERTAIN MATERIALS REQUIRED TO PRINT 1,000 BOOKS ON PAPER TO BE FURNISHED BY THE GOVERNMENT, IN ACCORDANCE WITH THE SPECIFICATIONS CONTAINED IN JACKET NO. 384194, AT A PRICE OF $2,110. TWO OTHER BIDS RECEIVED FOR THE JOB WERE $3,130 AND $3,250.

YOU STATE THAT THE CONTRACTING OFFICER TOOK NOTICE OF THE PROBABILITY THAT THE CORPORATION HAD MADE AN ERROR IN ITS LOW BID SINCE IT WAS OUT OF LINE WITH THE OTHER TWO BIDS. UPON BEING REQUESTED TO REVIEW THE SPECIFICATIONS AND CONFIRM ITS BID PRICE, THE CORPORATION PROMPTLY ADVISED IN TELEPHONE CONVERSATION AND BY CONFIRMING LETTER OF MAY 21, 1956, THAT IT HAD MADE A MATHEMATICAL ERROR OF $200 IN COMPUTING ITS BID AND THAT EXCEPT FOR THE ERROR ITS BID WOULD HAVE BEEN $2,310 INSTEAD OF $2,110. FORWARDED ITS ORIGINAL WORKSHEET IN WHICH THE BID WAS COMPUTED WHICH CLEARLY ESTABLISHES THAT, AS ALLEGED, AN ERROR OF $200 WAS MADE IN ADDING THE VARIOUS ITEMS OF ESTIMATED COSTS INVOLVED AND THAT ITS INTENDED BID ACTUALLY WAS $2,310.

ACCORDINGLY, SINCE IT WAS BELIEVED THAT THE BID WAS ERRONEOUS AND SINCE SUCH BELIEF WAS CONFIRMED AND THE ALLEGED ERROR AND INTENDED BID PRICE WERE SATISFACTORILY ESTABLISHED PRIOR TO AWARD, THE BID OF MONTAUK LITHOGRAPHERS, INC., MAY BE CORRECTED TO PROVIDE FOR A PRICE OF $2,310 INSTEAD OF $2,110 AND THE BID SO CORRECTED MAY BE CONSIDERED ALONG WITH THE OTHER BIDS IN MAKING THE AWARD.

IN THE EVENT OF AN AWARD TO MONTAUK LITHOGRAPHERS, INC., A REFERENCE TO THIS DECISION SHOULD BE MADE IN THE CONTRACT.

THE PAPERS, WITH THE EXCEPTION OF THE COPY OF THE TELEGRAM DATED MAY 21, 1956, FROM GOVERNMENT PRINTING OFFICE TO THE CORPORATION AND THE CORPORATION'S LETTER OF MAY 21, 1956, WITH ATTACHMENT, ARE RETURNED, AS REQUESTED.
