TO MISS JUANA BERNAL ROMERO: REFERENCE IS MADE TO YOUR RECENT LETTER REQUESTING REVIEW OF OUR SETTLEMENT DATED FEBRUARY 13. YOUR CLAIM WAS DISALLOWED BECAUSE THE RECORDS OF THE MARITIME ADMINISTRATION FAILED TO DISCLOSE THAT ANY UNPAID WAGES WERE DUE YOUR BROTHER FOR SERVICES RENDERED. B. CHARNEY VLADECK WAS OPERATED BY MERCHANTS AND MINERS TRANSPORTATION COMPANY. THE COMPANY COMPLETED FINAL LIQUIDATION IN 1952 AND IS NOW ENTIRELY OUT OF BUSINESS. THE BALANCE OF UNCLAIMED WAGES DUE EMPLOYEES OF THE COMPANY WAS TURNED OVER TO THE MARITIME ADMINISTRATION AND THE SUPPORTING WAGE REGISTER COVERING "ALL" THE UNCLAIMED WAGES OF SEAMEN AND SHIPYARD WORKERS CONCERNED WAS TRANSMITTED TO OUR OFFICE.

REFERENCE IS MADE TO YOUR RECENT LETTER REQUESTING REVIEW OF OUR SETTLEMENT DATED FEBRUARY 13, 1956, WHICH DISALLOWED YOUR CLAIM, AS SISTER OF FRANCISCO B. ROMERO, DECEASED, FOR UNPAID WAGES BELIEVED DUE THE DECEDENT ON DATE OF DEATH WHILE EMPLOYED ON THE S.S. B. CHARNEY VLADECK.

YOUR CLAIM WAS DISALLOWED BECAUSE THE RECORDS OF THE MARITIME ADMINISTRATION FAILED TO DISCLOSE THAT ANY UNPAID WAGES WERE DUE YOUR BROTHER FOR SERVICES RENDERED.

IT APPEARS THAT THE S.S. B. CHARNEY VLADECK WAS OPERATED BY MERCHANTS AND MINERS TRANSPORTATION COMPANY, BALTIMORE, MARYLAND, DURING WORLD WAR II, WHILE THAT COMPANY ACTED AS GENERAL AGENT FOR THE UNITED STATES WAR SHIPPING ADMINISTRATION. THE COMPANY COMPLETED FINAL LIQUIDATION IN 1952 AND IS NOW ENTIRELY OUT OF BUSINESS. THE BALANCE OF UNCLAIMED WAGES DUE EMPLOYEES OF THE COMPANY WAS TURNED OVER TO THE MARITIME ADMINISTRATION AND THE SUPPORTING WAGE REGISTER COVERING "ALL" THE UNCLAIMED WAGES OF SEAMEN AND SHIPYARD WORKERS CONCERNED WAS TRANSMITTED TO OUR OFFICE. HOWEVER, THE NAME OF YOUR BROTHER DOES NOT APPEAR ON THE WAGE REGISTER. YOU WILL UNDERSTAND, WE ARE SURE, THAT IN THE ABSENCE OF CONCLUSIVE EVIDENCE TO THE CONTRARY OUR ACTION ON YOUR CLAIM NECESSARILY MUST BE GUIDED BY THE OFFICIAL RECORDS PRESENTED TO US BY THE AGENCY OF THE GOVERNMENT PRIMARILY RESPONSIBLE FOR THE MAKING OF THE RECORDS.

IN THE LIGHT OF THE FOREGOING, OUR SETTLEMENT DATED FEBRUARY 13, 1956, WAS PROPER AND, UPON REVIEW, MUST BE AND IS SUSTAINED.

CONCERNING OUR REQUEST FOR A GRANT OF MONEY, WE REGRET TO INFORM YOU THAT OUR OFFICE MAY AUTHORIZE THE DISBURSEMENT OF GOVERNMENT FUNDS ONLY IN ACCORD WITH ACTS OF CONGRESS. WE ARE UNAWARE OF ANY SUCH ACT WHICH WOULD AUTHORIZE A GRANT OF MONEY IN YOUR CASE.
