VETERANS ADMINISTRATION: REFERENCE IS MADE TO YOUR LETTER OF APRIL 2. FOUR OTHER BIDS WERE RECEIVED IN THE AMOUNTS OF $946 (NONRESPONSIVE BID). THAT ITS BID PRICE OF $946 WERE ERRONEOUS IN THAT IT WAS BASED ON FURNISHING A STANDARD MODEL REFRIGERATOR WHICH. DID NOT HAVE A STAINLESS STEEL INTERIOR AND EXTERIOR FINISH AND STAINLESS SHELVES. THAT THE CORRECT PRICE FOR THE REQUIRED REFRIGERATOR IS $1. THERE IS NO ROOM FOR DOUBT THAT THE COMPANY MADE AN ERROR IN ITS BID.

REFERENCE IS MADE TO YOUR LETTER OF APRIL 2, 1956, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN CONCERNING AN ERROR THE A. DAIGGER AND COMPANY ALLEGES IT MADE IN ITS BID OPENED ON MARCH 9, 1956.

THE VETERANS ADMINISTRATION HOSPITAL, SAN FRANCISCO, CALIFORNIA, BY INVITATION NO. 56-46, REQUESTED BIDS FOR FURNISHING ONE BLOOD BANK REFRIGERATOR, JEWETT MODEL NO. 2 OR EQUAL, COMPLETE WITH ALARM DEVICE, AND SEVEN-DAY RECORDING THERMOMETER WITH CHARTS. THE SPECIFICATIONS PROVIDED, AMONG OTHER THINGS, THAT THE REFRIGERATOR BE CONSTRUCTED OF STAINLESS STEEL, INSIDE AND OUTSIDE, AND THAT THERE BE FOUR STAINLESS STEEL SHELVES. IN RESPONSE, THE A. DAIGGER AND COMPANY SUBMITTED A BID DATED MARCH 5, 1956, OFFERING TO FURNISH A JEWETT MODEL NO. 2 REFRIGERATOR AT A PRICE OF $946. FOUR OTHER BIDS WERE RECEIVED IN THE AMOUNTS OF $946 (NONRESPONSIVE BID), $1,216, $1,249.69, AND $1,306 (BID OF MANUFACTURER OF THE REQUIRED PRODUCT.)

UPON BEING REQUESTED TO VERIFY ITS BID, THE A. DAIGGER AND COMPANY ADVISED BY LETTER DATED MARCH 22, 1956, THAT ITS BID PRICE OF $946 WERE ERRONEOUS IN THAT IT WAS BASED ON FURNISHING A STANDARD MODEL REFRIGERATOR WHICH, IT STATED, DID NOT HAVE A STAINLESS STEEL INTERIOR AND EXTERIOR FINISH AND STAINLESS SHELVES, AND THAT THE CORRECT PRICE FOR THE REQUIRED REFRIGERATOR IS $1,271. IN SUPPORT OF ITS ALLEGATION OF ERROR, THE COMPANY SUBMITTED A PHOTOSTATIC COPY OF A SHEET FROM THE SUBJECT INVITATION WHICH, IT STATED, IT USED AS ITS WORKSHEET.

ON THE BASIS OF FACTS AND EVIDENCE OF RECORD, THERE IS NO ROOM FOR DOUBT THAT THE COMPANY MADE AN ERROR IN ITS BID, AS ALLEGED. ACCORDINGLY, THE BID OF THE A. DAIGGER AND COMPANY MAY BE DISREGARDED IN MAKING THE AWARD.
