RECEIPT IS ACKNOWLEDGED OF LETTER OF MARCH 15, 1956, WRITTEN IN YOUR BEHALF BY MESSRS. FINK, MCNAMEE AND PAVIA, REGARDING THE ADDITIONAL AMOUNT BELIEVED TO BE DUE THE ESTATE OF THEODORO RANDI, DECEASED. THERE ARE ENCLOSED WITH THAT LETTER EIGHT ORIGINAL RECEIPTS SHOWING DEPOSITS TOTALING $247.71.

A SETTLEMENT IN FAVOR OF THE DECEDENT WAS MADE BY OUR OFFICE IN JANUARY 17, 1955, IN THE AMOUNT OF $135.66, RECEIPT OF WHICH HAS BEEN ACKNOWLEDGED BY YOUR ATTORNEY. AS YOU WERE INFORMED IN OUR LETTER OF FEBRUARY 29, 1956, WE HAVE BEEN UNABLE TO LOCATE A COMPLETE RECORD OF THE DECEDENT'S DEPOSITS AND WITHDRAWALS. THE RECEIPTS NOW FURNISHED BY YOU REPRESENT THE AMOUNTS REPORTED IN YOUR ATTORNEY'S LETTER OF APRIL 14, 1955, BUT ADD NOTHING TO OUR LACK OF INFORMATION REGARDING THE DECEDENT'S WITHDRAWALS.

IN RESPONSE TO OUR REQUEST FOR AN ADMINISTRATIVE REPORT ON THIS MATTER THE FOLLOWING REPORT OF OCTOBER 26, 1955, WAS RECEIVED.

"REFERENCE IS MADE TO YOUR LETTER DATED MAY 4, 1955, FILE CE-Z 524231-HCS -5, TRANSMITTING TO THIS OFFICE FOR ADMINISTRATIVE EXAMINATION AND REPORT, A LETTER FROM FINK, MCNAMEE AND PAVIA, ATTORNEYS AT LAW, WHICH WAS WRITTEN ON BEHALF OF THE CONSUL GENERAL OF ITALY, IN CONNECTION WITH MONIES ALLEGEDLY DUE THE HEIRS OF TEODORO RANDI, A FORMER INTERNED ENEMY ALIEN.

"WE REGRET TO ADVISE YOU THAT WE HAVE BEEN UNABLE TO LOCATE THE FINANCIAL RECORDS RELATING THIS CASE, WHICH WOULD REFLECT THE AMOUNT OF EACH DEPOSIT AND/OR WITHDRAWAL MADE BY THE DECEDENT.

"HOWEVER, IN REVIEWING MR. RANDI'S ALIEN FILE, IT IS NOTED THAT ON APRIL 22, 1944, THE OFFICER IN CHARGE AT FORT MISSOULA, MONTANA TRANSMITTED U.S. TREASURY CHECK NO. 14,579, IN THE AMOUNT OF $107.71, TO THE DECEDENT, AT THE U.S. MARINE HOSPITAL, ELLIS ISLAND, NEW YORK. THIS CHECK REPRESENTED THE BALANCE IN MR. RANDI'S ACCOUNT, ON THE DATE OF HIS TRANSFER FROM FORT MISSOULA, MONTANA TO ELLIS ISLAND, NEW YORK. THE CHECK WAS RECEIVED BY IMMIGRATION AUTHORITIES ON ELLIS ISLAND, AND FORWARDED, ON MAY 4, 1944, TO MR. RANDI AT THE U.S. MARINE HOSPITAL, STAPLETON, STATEN ISLAND, WHERE HE HAD BEEN TRANSFERRED FOR FURTHER MEDICAL TREATMENT. A COPY OF EACH TRANSMITTAL LETTER IS ENCLOSED FOR YOUR INFORMATION.

"OUR RECORDS FURTHER INDICATE THAT ON MAY 11, 1944, THE DECEDENT WAS TRANSFERRED FROM THE U.S. MARINE HOSPITAL, STAPLETON, STATEN ISLAND, TO THE U.S. MARINE HOSPITAL, ELLIS ISLAND, NEW YORK WHERE HE REMAINED UNTIL HIS DEATH ON AUGUST 11, 1944. ON AUGUST 12, 1944, THERE WAS ON DEPOSIT IN THE TREASURER'S OFFICE ELLIS ISLAND, A TOTAL OF $135.66, WHICH INCLUDED $28.66 IN CASH THAT HAD BEEN FOUND AMONG THE DECEDENT'S PERSONAL EFFECTS. THIS SUM WAS SUBSEQUENTLY DEPOSITED TO TRUST FUND ACCOUNT 158915,"DEPOSITS, FUNDS OF CIVILIAN INTERNEES AND PRISONERS OF WAR" ON SCHEDULE OF COLLECTION NO. C-MISC. 377, C.D. NO. 24916 DATED FEBRUARY 28, 1949, PAUL D. BANNING, DISBURSING OFFICER, SYMBOL NO. 300.'

THE AMOUNT ALLOWED IN THE SETTLEMENT WAS THE BALANCE ADMINISTRATIVELY REPORTED AND IN THE ABSENCE OF RECORDS SHOWING HOW THAT BALANCE WAS ARRIVED AT, THAT IS, WHAT AMOUNTS WERE WITHDRAWN BY THE DECEDENT, OUR OFFICE IS WITHOUT SUFFICIENT EVIDENCE TO WARRANT ANY ADDITIONAL ALLOWANCE ON ..END :
