PRECIS-UNAVAILABLE SECRETARY OF THE NAVY: REFERENCE IS MADE TO LETTER OF MARCH 12. REQUESTING DECISION AS TO WHETHER MEMBERS OF THE ARMED FORCES ARE ENTITLED TO TEMPORARY STORAGE OF HOUSEHOLD EFFECTS AT GOVERNMENT EXPENSE UNDER THE PROVISIONS OF PARAGRAPH 8006-1. IT IS FURTHER PROVIDED THAT OWNERS WILL NOT REQUEST TEMPORARY STORAGE IN CONTEMPLATION OF SUBSEQUENT STORAGE UNDER THE PROVISIONS OF SUBPARAGRAPH 2. THE GRANTING OF A REQUEST FOR NONTEMPORARY STORAGE WILL DEPEND UPON WHETHER FACILITIES ARE AVAILABLE. IT IS FURTHER PROVIDED THAT MEMBERS WILL NOT REQUEST TEMPORARY STORAGE MENTIONED IN SUBPARAGRAPH 1A IN CONTEMPLATION OF SUBSEQUENT STORAGE UNDER THESE PROVISIONS. TEMPORARY STORAGE IS AUTHORIZED UNDER THE REGULATIONS WHENEVER NECESSARY IN CONNECTION WITH A SHIPMENT OF EFFECTS INCIDENT TO A PERMANENT CHANGE OF STATION.

REFERENCE IS MADE TO LETTER OF MARCH 12, 1956, FROM THE ASSISTANT SECRETARY OF THE NAVY, PERSONNEL AND RESERVE FORCES, REQUESTING DECISION AS TO WHETHER MEMBERS OF THE ARMED FORCES ARE ENTITLED TO TEMPORARY STORAGE OF HOUSEHOLD EFFECTS AT GOVERNMENT EXPENSE UNDER THE PROVISIONS OF PARAGRAPH 8006-1, JOINT TRAVEL REGULATIONS, WHEN ORDERED TO SEA DUTY, TO DUTY OVERSEAS, OR RELEASED FROM ACTIVE DUTY.

SECTION 303(C) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 814, PROVIDES THAT MEMBERS OF THE UNIFORMED SERVICES SHALL BE ENTITLED, IN CONNECTION WITH A CHANGE OF STATION, TO TRANSPORTATION (INCLUDING PACKING, CRATING, DRAYAGE, TEMPORARY STORAGE AND UNPACKING) OF BAGGAGE AND HOUSEHOLD EFFECTS TO AND FROM SUCH LOCATIONS AS MAY BE PRESCRIBED BY THE SECRETARIES CONCERNED. PARAGRAPH 8006-1, JOINT TRAVEL REGULATIONS, PROMULGATED PURSUANT TO THAT SECTION, AUTHORIZED TEMPORARY STORAGE OF HOUSEHOLD EFFECTS OF MEMBERS AT GOVERNMENT EXPENSE WHENEVER NECESSARY IN CONNECTION WITH A PERMANENT CHANGE OF STATION BECAUSE OF CONDITIONS BEYOND CONTROL OF THE MEMBER. IT IS FURTHER PROVIDED THAT OWNERS WILL NOT REQUEST TEMPORARY STORAGE IN CONTEMPLATION OF SUBSEQUENT STORAGE UNDER THE PROVISIONS OF SUBPARAGRAPH 2. PARAGRAPH 8006-2 OF THE SAME REGULATIONS PROVIDES THAT UPON BEING ORDERED DIRECT TO SEA DUTY OR DIRECT TO DUTY OUTSIDE THE UNITED STATES, MEMBERS MAY APPLY FOR NONTEMPORARY STORAGE OF THEIR HOUSEHOLD EFFECTS AT AN INSTALLATION OF THE SERVICE CONCERNED. THE GRANTING OF A REQUEST FOR NONTEMPORARY STORAGE WILL DEPEND UPON WHETHER FACILITIES ARE AVAILABLE. IT IS FURTHER PROVIDED THAT MEMBERS WILL NOT REQUEST TEMPORARY STORAGE MENTIONED IN SUBPARAGRAPH 1A IN CONTEMPLATION OF SUBSEQUENT STORAGE UNDER THESE PROVISIONS.

TEMPORARY STORAGE IS AUTHORIZED UNDER THE REGULATIONS WHENEVER NECESSARY IN CONNECTION WITH A SHIPMENT OF EFFECTS INCIDENT TO A PERMANENT CHANGE OF STATION. WHILE MEMBERS MAY APPLY FOR NONTEMPORARY STORAGE UPON BEING ORDERED TO SEA DUTY OR TO DUTY OUTSIDE THE UNITED STATES, THERE APPEARS TO BE NOTHING IN THE REGULATIONS PROHIBITING TEMPORARY STORAGE IN CONNECTION WITH A SHIPMENT OF EFFECTS IN OTHERWISE PROPER CASES MERELY BECAUSE A MEMBER IS ASSIGNED TO SEA DUTY OR TO DUTY OVERSEAS.

PARAGRAPH 8009-5, JOINT TRAVEL REGULATIONS, PROVIDES THAT UPON RELEASE FROM ACTIVE DUTY MEMBERS ARE ENTITLED TO SHIPMENT OF HOUSEHOLD GOODS FROM THE LAST DUTY STATION, OR PLACE TO WHICH SUCH GOODS WERE PREVIOUSLY SHIPPED AT GOVERNMENT EXPENSE, TO THE PLACE TO WHICH THE MEMBER ELECTS TO RECEIVE TRAVEL ALLOWANCES FOR HIS TRAVEL UNDER THE PROVISIONS OF PARAGRAPH 4157 OF THE REGULATIONS. THUS, SHOULD TEMPORARY STORAGE OF HOUSEHOLD EFFECTS SHIPPED INCIDENT TO MEMBER'S RELEASE FROM ACTIVE DUTY BECOME NECESSARY BECAUSE OF CONDITIONS BEYOND CONTROL OF THE MEMBER, SUCH STORAGE IS AUTHORIZED AT GOVERNMENT EXPENSE THE SAME AS FOR ANY OTHER PERMANENT CHANGE OF STATION, IF THE NECESSITY FOR STORAGE IS CERTIFIED TO BY PROPERLY DESIGNATED AUTHORITY HAVING KNOWLEDGE OF THE FACTS. 32 COMP.
