B-127196, MAR. 8, 1956

TO THE HONORABLE RAYMOND BLATTENBERGER, PUBLIC PRINTER:

REFERENCE IS MADE TO YOUR LETTER OF MARCH 2, 1956, WITH ENCLOSURES, REQUESTING A DECISION AS TO WHETHER A BID DATED FEBRUARY 21, 1956, SUBMITTED BY RICHTER MCCALL AND COMPANY MAY BE DISREGARDED IN VIEW OF THE COMPANY'S ALLEGATION OF ERROR.

ON THE BASIS OF THE FACTS AND EVIDENCE OF RECORD, INCLUDING THE DISCREPANCY BETWEEN THE COMPANY'S BID AND THE OTHER TWO BIDS RECEIVED, THE COMPANY'S EXPLANATORY LETTER OF FEBRUARY 27, 1956, AND ITS ORIGINAL WORKSHEET FURNISHED IN SUPPORT OF ITS ALLEGATION OF ERROR, THERE IS NO DOUBT THAT A BONA FIDE ERROR WAS MADE BY THE COMPANY IN COMPUTING ITS BID PRICE.

ACCORDINGLY, SINCE RICHTER MCCALL AND COMPANY ADVISED OF AN ERROR IN ITS BID PROMPTLY AFTER THE OPENING AND ESTABLISHED PRIOR TO AWARD THAT THE ERROR WAS MADE AS ALLEGED, THE COMPANY'S BID SHOULD BE DISREGARDED.

THE PAPERS, WITH THE EXCEPTION OF THE COMPANY'S LETTER OF FEBRUARY 27, 1956, AND ITS WORKSHEETS, ARE RETURNED, AS REQUESTED.
