IN YOUR LETTER OF JANUARY 16, 1956, YOU REQUEST A DECISION WHETHER PAYMENT IS AUTHORIZED ON A VOUCHER STATED IN FAVOR OF BRIGADIER GENERAL WILLIAM M. BRECKINRIDGE, 017210, USA, FOR REIMBURSEMENT OF THE COST OF TRANSPORTATION OF HIS UNMARRIED LEGITIMATE DAUGHTER, BARBARA ANN BRECKINRIDGE, AGE 21, FROM FORT SAM HOUSTON, TEXAS, TO WEST CHESTER, PENNSYLVANIA, THE TRAVEL HAVING BEEN PERFORMED ON JANUARY 4 AND 5, 1956, INCIDENT TO PERMANENT CHANGE OF STATION ORDERS DATED DECEMBER 21, 1955.

IT APPEARS FROM THE EVIDENCE SUBMITTED THAT WHEN THE TRAVEL WAS PERFORMED THE OFFICER HAD A ,DEPENDENT" WITHIN THAT PART OF THE DEFINITION CONTAINED IN SUBSECTION 102 (G) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 804, WHICH PROVIDES THAT SUCH TERM SHALL INCLUDE UNMARRIED LEGITIMATE CHILDREN OVER 21 YEARS OF AGE WHO ARE INCAPABLE OF SELF-SUPPORT BECAUSE OF BEING MENTALLY DEFECTIVE OR PHYSICALLY INCAPACITATED AND WHO ARE IN FACT DEPENDENT ON THE MEMBER FOR OVER HALF OF HIS OR HER SUPPORT.

ACCORDINGLY THE VOUCHER AND SUPPORTING PAPERS ARE RETURNED, PAYMENT ON THE VOUCHER BEING AUTHORIZED, IF OTHERWISE CORRECT.
