COVER VERY SIMILAR SITUATIONS IN WHICH THE SHIPMENTS WERE TRANSPORTED ON GOVERNMENT BILLS OF LADING TO AND FROM THE PORT OF NEW YORK. WHAT WAS SAID IN THOSE DECISIONS APPEARS TO BE EQUALLY APPLICABLE TO THE SHIPMENTS REFERRED TO IN YOUR LETTER. INSOFAR AS TRANSPORTATION CHARGES ARE CONCERNED.

REFERENCE IS MADE TO YOUR LETTER OF JULY 24, 1957, FILE 77-1-1080 FRUSTRATED FRT., CONCERNING THE DECISION OF MARCH 12, 1957 (B-126798), ON FRUSTRATED FREIGHT TRANSPORTED ON COMMERCIAL BILLS OF LADING TO NEW YORK, NEW YORK, FOR EXPORT, AND REQUESTING OUR VIEWS AS TO SUCH SHIPMENTS TRANSPORTED ON GOVERNMENT BILLS OF LADING FROM PONTIAC, MICHIGAN, TO NEW YORK, NEW YORK, FOR EXPORT, WHICH UPON ARRIVAL AT NEW YORK WERE RESHIPPED TO NORFOLK, VIRGINIA, FOR EXPORT.

OUR OFFICE HAS BEEN UNABLE TO LOCATE ANY RECORD OF THE SPECIFIC SHIPMENTS TO WHICH YOU REFER. HOWEVER, THE DECISIONS OF MARCH 21, 1956, (B-126802), AND APRIL 24, 1956 (B-126779), REFERRING TO YOUR FILES 77-5465-2/43 AND 77 -1803-2-43, COVER VERY SIMILAR SITUATIONS IN WHICH THE SHIPMENTS WERE TRANSPORTED ON GOVERNMENT BILLS OF LADING TO AND FROM THE PORT OF NEW YORK. WHAT WAS SAID IN THOSE DECISIONS APPEARS TO BE EQUALLY APPLICABLE TO THE SHIPMENTS REFERRED TO IN YOUR LETTER. INSOFAR AS TRANSPORTATION CHARGES ARE CONCERNED, WE SEE NO DIFFERENCE BETWEEN SHIPMENTS TRANSPORTED TO THE PORTS FOR EXPORT ON COMMERCIAL BILLS OF LADING AND THOSE TRANSPORTED ON GOVERNMENT BILLS OF LADING.
