REFERENCE IS MADE TO YOUR LETTER OF DECEMBER 27, 1955, WITH ENCLOSURES, REQUESTING A DECISION AS TO WHETHER A BID DATED DECEMBER 19, 1955, SUBMITTED BY PHILIP HANO CO., INC., MAY BE DISREGARDED IN VIEW OF THE BIDDER'S ALLEGATION OF ERROR.

ON THE BASIS OF THE FACTS AND EVIDENCE OF RECORD, INCLUDING A COPY OF THE SUPPLIER'S TELEGRAM DATED DECEMBER 19, 1955, TO THE BIDDER'S REPRESENTATIVE, THERE IS NO DOUBT THAT A BONA FIDE ERROR WAS MADE IN THE BID AS ALLEGED.

ACCORDINGLY, SINCE THE ERROR WAS ALLEGED PRIOR TO AWARD AND SINCE YOU STATE THAT THE CONTRACTING OFFICER BELIEVES THAT AN ERROR WAS MADE AS ALLEGED BY PHILIP HANO CO., INC., THE COMPANY'S BID MAY BE DISREGARDED IN MAKING THE AWARD.

THE PAPERS, WITH THE EXCEPTION OF THE BIDDER'S LETTER OF DECEMBER 21, 1955, AND ATTACHMENTS, ARE RETURNED AS REQUESTED.
