TO MR. MICHAEL RUDISIN, DIRECTOR OF FISCAL ACCOUNTS, RAILROAD RETIREMENT BOARD:

REFERENCE IS MADE TO YOUR LETTER OF DECEMBER 8, 1955, REQUESTING AN OPINION REGARDING THE DISPOSITION OF SALARY CHECKS AND SAVINGS BONDS ISSUED IN THE NAME OF AN EMPLOYEE WHO HAS BEEN COMMITTED TO A HOSPITAL AS MENTALLY ILL.

PENDING RECEIPT OF A CLAIM FOR THE PROCEEDS OF THE CHECKS FROM A GUARDIAN, COMMITTEE OR RELATIVE OF THE INSTANT EMPLOYEE, THE CHECKS SHOULD BE TREATED AS UNDELIVERABLE AND RETURNED TO THE DISBURSING AGENCY FOR SAFEKEEPING IN ACCORDANCE WITH PARAGRAPH 10, GENERAL REGULATIONS NO. 118, REVISED, JUNE 29, 1955, 34 COMP. GEN. 757. WHEN SUCH CLAIM IS RECEIVED, THE CHECKS SHOULD BE RECALLED FROM THE DISBURSING AGENCY AND FORWARDED ALONG WITH THE CLAIM TO THE GENERAL ACCOUNTING OFFICE FOR SETTLEMENT ACTION IN ACCORDANCE WITH PARAGRAPH 3, GENERAL REGULATIONS NO. 104, REVISED, APRIL 5, 1951, 30 COMP. GEN. 580.

IT WOULD APPEAR THAT THE SAVINGS BONDS MAY BE DEPOSITED WITH THE TREASURER OF THE UNITED STATES FOR SAFEKEEPING PURSUANT TO 31C.F.R. 315.16. REQUESTS FOR PROCEDURAL INSTRUCTIONS, HOWEVER, SHOULD BE ADDRESSED TO THE TREASURER OF THE UNITED STATES.
