SINCE THE CHOICE BETWEEN THE TWO ALTERNATES IS A MATTER PRIMARILY FOR DETERMINATION BY THE DEPARTMENT OF THE NAVY. WE HAVE BEEN FURNISHED A COPY OF YOUR LETTER OF JANUARY 17 TO THE CHIEF.

FURTHER REFERENCE IS MADE TO COPY OF YOUR TELEGRAM OF DECEMBER 2, 1955, TO THE CHIEF, BUREAU OF SHIPS, DEPARTMENT OF THE NAVY, PROTESTING THE AWARD OF A CONTRACT TO INGERSOLL-RAND COMPANY FOR TURBINE DRIVEN MAIN FEED PUMPS FOR AIRCRAFT CARRIERS, TYPE CVA-63.

IN RESPONSE TO OUR REQUEST THE DEPARTMENT OF THE NAVY HAS FURNISHED A REPORT OF THE FACTS IN THE MATTER, TOGETHER WITH A COPY OF THE REQUEST FOR PROPOSALS AND A COPY OF LETTER DATED DECEMBER 6, 1955, FROM THE CHIEF, BUREAU OF SHIPS, REPLYING TO YOUR TELEGRAM. THE DEPARTMENT REPORTS THAT ALTHOUGH YOU REDUCED THE AMOUNT OF YOUR PROPOSAL ON ALTERNATE A FROM $613,770 TO $585,515 DURING THE NEGOTIATION, IT STILL WAS NOT THE LOWEST RECEIVED EITHER ON THAT ALTERNATE OR ON ALTERNATE B OF THE REQUEST FOR PROPOSALS. IT IS REPORTED, AS STATED IN THE LETTER OF DECEMBER 6, 1955, TO YOU, THAT THE CONTRACT WAS AWARDED TO THE INGERSOLL-RAND COMPANY, THE LOWEST BIDDER AS TO PRICE ON ALTERNATE B. IN VIEW OF SUCH FACT, AND SINCE THE CHOICE BETWEEN THE TWO ALTERNATES IS A MATTER PRIMARILY FOR DETERMINATION BY THE DEPARTMENT OF THE NAVY, WE PERCEIVE NO LEGAL BASIS FOR FURTHER ACTION BY OUR OFFICE.

WE HAVE BEEN FURNISHED A COPY OF YOUR LETTER OF JANUARY 17 TO THE CHIEF, BUREAU OF SHIPS, IN WHICH YOU EXPRESS YOUR APPRECIATION FOR THE TIME GIVEN BY HIM TO YOUR REPRESENTATIVES IN REVIEWING THE MATTER OF THE FEED SYSTEM PUMPS FOR THE CARRIER AND THE COMPRESSORS FOR THE OXYGEN PLANTS FROM WHICH WE ASSUME THAT THE MATTER HAS BEEN MORE FULLY CLARIFIED.
