YOU REQUEST A DECISION WHETHER PAYMENT IS AUTHORIZED ON A VOUCHER STATED IN FAVOR OF LIEUTENANT COLONEL KENNETH L. IT APPEARS FROM THE EVIDENCE SUBMITTED THAT DURING THE PERIOD THE TRAVEL WAS PERFORMED THE OFFICER HAD A "DEPENDENT" WITHIN THAT PART OF THE DEFINITION CONTAINED IN SUBSECTION 102 (G) OF THE CAREER COMPENSATION ACT OF 1949. WHICH PROVIDES THAT SUCH TERM SHALL INCLUDE UNMARRIED LEGITIMATE CHILDREN OVER TWENTY-ONE YEARS OF AGE WHO ARE INCAPABLE OF SELF-SUPPORT BECAUSE OF BEING PHYSICALLY INCAPACITATED AND WHO ARE IN FACT DEPENDENT ON THE MEMBER FOR OVER HALF OF HIS OR HER SUPPORT. THE VOUCHER AND SUPPORTING PAPERS ARE RETURNED.

IN YOUR LETTER OF NOVEMBER 3, 1955, YOU REQUEST A DECISION WHETHER PAYMENT IS AUTHORIZED ON A VOUCHER STATED IN FAVOR OF LIEUTENANT COLONEL KENNETH L. BOGGS, 0277052, ARTILLERY, FOR REIMBURSEMENT OF THE COST OF TRANSPORTATION OF HIS UNMARRIED LEGITIMATE SON, ROGER D. BOGGS, AGE 26, FROM EAU CLAIRE, WISCONSIN, TO JUNCTION CITY, KANSAS, THE TRAVEL HAVING BEEN PERFORMED BETWEEN AUGUST 9 AND 11, 1955, INCIDENT TO PERMANENT CHANGE OF STATION ORDER DATED JUNE 2, 1955.

IT APPEARS FROM THE EVIDENCE SUBMITTED THAT DURING THE PERIOD THE TRAVEL WAS PERFORMED THE OFFICER HAD A "DEPENDENT" WITHIN THAT PART OF THE DEFINITION CONTAINED IN SUBSECTION 102 (G) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 804, WHICH PROVIDES THAT SUCH TERM SHALL INCLUDE UNMARRIED LEGITIMATE CHILDREN OVER TWENTY-ONE YEARS OF AGE WHO ARE INCAPABLE OF SELF-SUPPORT BECAUSE OF BEING PHYSICALLY INCAPACITATED AND WHO ARE IN FACT DEPENDENT ON THE MEMBER FOR OVER HALF OF HIS OR HER SUPPORT.

ACCORDINGLY, THE VOUCHER AND SUPPORTING PAPERS ARE RETURNED, PAYMENT ON THE VOUCHER BEING AUTHORIZED, IF OTHERWISE CORRECT.
